(561) become perfect Tenant of the freehold and Inheritance of the said premisses that a Common recovery may be had and suffered against him in such manner as is herein after Mentioned and for that Purpose it is hereby Covenanted granted and Agreed by and between all the parties to these presents that before the end of the next May Provincial Court one or more Writt or Writts of Entry sur Disseisin en le post at the Costs and Charges of the said John Moore shall and may be brought and prosecuted against him the said William Paca in the name of him the said George Chalmers as plaintiff or Demandant therein of and for the aforesaid several Tracts or parcels of Land and Premisses with the Appurtenances by such name or names Quantity Quality Number or Content of Acres or Other Certainties and descriptions as shall be Apt and Convenient in that Behalf to which writt or Writts the said William Paca shall appear gratis in his proper person or by his Attorney or Attornies lawfully authorized and shall vouch to warrant the premisses the said John Moore and Cassandra his Wife who shall Likewise appear gratis in their proper persons or by their Attorney or Attornies Lawfully Authorized and shall and will enter into the said warranty and vouch over to warrant the said premisses the Common vouchee who shall thereupon appear and enter into the said Warranty and after Imparlance make default and such further and other proceedings shall be therein so that one more or good perfect Common Recovery or Recoveries with double Voucher shall and may be had Suffered perfected and executed in all things according to the usual form of Common Recoveries with double voucher for assurance of Lands in such Case Used and Accustomed and it is further covenanted and Agreed concluded granted and fully Declared by and between all the said parties to these presents that from and after the Suffering and perfecting the said Common Recovery or Recoveries as well these presents and the Assurance hereby made as also the Common Recovery or Recoveries so as aforesaid or in any Other Manner to be had suffered and perfected shall be and enure and shall be Adjudged Construed deemed and taken and are and were meant and entended and are hereby declared to be and enure to the said George Chalmers his heirs and assigns and that the said George Chalmers his Heirs and Assigns shall Stand and be Seised of the aforesaid several Tracts or parcels of Land and every part thereof to and for the Uses Intents and purposes following to wit to and for the use of the aforesaid Cassandra for and during her life and Afterwards to and for the use of the said John Moore his heirs and Assigns forever In Witness whereof the parties to these presents have hereunto set their Hands & Seals the day & year above written Jn.o Moore (Seal) Signed Sealed and Delivered Cassandra Mooree (seal) in Presence of W.m Paca (seal) Jos Garnett Ge.o Chalmers (seal) On the back of the aforegoing Deed was thus Endorsed to wit Received the Day and Year within written of the within named William Paca the sum of five Shillings Sterling Money in full for the Consideration Money therein Mentioned to be by him paid to Us John Moore Witness Jn Garnett Cassandra Moore On the twenty third day of May 1769 Came before me the Subscriber one of his Lordships Justices of the provincial Court the within named John Moore and Cassandra his Wife and Severally Acknowledged the within Deed to be their respective Act and Deed and that the within named premisses were the Right and Estate of the within mentioned William Paca his heirs and Assigns forever to and for the uses intents and purposes of the within Deed and according to the true intent and Meaning thereof And the said Cassandra being by me examined Apart from and Out of the hearing of her said husband John Moore did repeat as aforesaid and did further declare that she had by the within writing Released and did thereby intend to release all her Right and Title to the within premisses and that she executed the said Writing of her own free will and Consent without any Compulsion or threats from her said Husband or for fear of his Displeasure Geo Steuart recorded the 23.d Day of May 1769 |
