(553) & forever discharge by these p.rsents as also for diverse other Good Causes & Valuable Consideracons him the said William Coale likewise thereunto especially moveing have given granted bargained Sold Aliened Enfeoffed and Confirmed And by these p.rsents Doth freely Clearly & Absolutely give grant bargain Sell Alien Enfeoff & Confirme unto the said Joseph Williams his Heires and Assignes forever a certain Tract or pcell of Land being taken out of a greater Quantity called Hickory Hills begining at the Westermost bounded Red oake of the said Land & running North Eighty six pches & one halfe pch to a Bounded Hickory then with a Line drawne East too hundred & nineteen pches to a bounded Hickory tree of another pat.r & pcell of the s.d Land called Hickory Hills lately Purchased by one Henry Hanslapp of the afores.d Cot.y Gent then runing South with Line of the s.d Hanslapp's Land Eighty six pches & one halfe pch to a stake or Pine Tree appointed to be planted in the South Bounds of the said Land then running West to first Bounded Tree Containing & Laid out for one hundred Acres more or Lesse Together with all the Trees Timber Trees Woods & Und.r woods now Standing growing or being in or upon the said Tract or pcell of Land or any pat.r or pcell thereof And also all the writeings Patents escripts & Minum.t to the same belonging To have and to hold the same or any pat.r or pcell thereof unto him the s.d Jo.s Williams his Heires & Assignes for ever to the onely pper Use & Behoofe of him the said Joseph Williams his Heires & Assignes for ever & to none other Use Intent or Purpose whatsoever & the said William Coale for himself his Heirs Exr.s & Adma.rs Doth covenant pmise grant & agree to & w.th the said Joseph Williams his Heires Exr.s Adma.rs & Assignes y.t he the said William Coale at the time of the Ensealing & Delivery of these p.rsents of the Land & P.rmisses & of every pat.r & pcell thereof standeth seised of a good sure firme Title & Estate of Inheritance free & Cleare of all Incumberances whatsoever (the Rents & services for the same from this time to become due & Payable unto the Lord or Lords of the fee of the p.rmisses (Royall Mines also excepted & foreprised) And that he y.e said William Cale in himselfe good Right full Power & Lawfull Authority to grant bargain & sell the same and every pat.r & pcell thereof to him the said Joseph Williams his Heires Ex.rs Adma.rs & Assigns in manner & forme as in these p.rsents before is Expressed And also y.t he the s.d Jo.s Williams his Heires & Assignes shall & may from henceforth forever peaceably & quiettly have hold use occupy possess & enjoy without the lett interrupcon disturbance of him the said William Coale his Heires Ex.rs & Adma.rs Doth covenant grant & Agree to & with the s.d Jo.s Williams his Heires & Assignes by these psents y.t he the said William Coale his Heires Ex.rs & Adma.rs shall at any time within these seven yeares doe make execute & Acknowledg cause to be made done executed & acknowledged such further Act or Acts thing or things device or devices assurance or assurances in the Lawe to the said Jo.s Williams his Heires or Assignes or his or their Councell Learned in the Lawe shall be reasonably devised advised or required In Witness n.r of the Pat.y first above named to this p.rsent Indenture hath hereunto Sett hand & seale the day & yeare first above written Signed sealed & dd In y.e p.rsence of us On the back of the aforegoing Deed was thus Endorsed to wit Then Came before us the within menconed William Coale & according to Act of Assembly in y.t Case pvided acknowledged the within menconed writeing to be his Act & Deed Thomas Miller Thomas Tench Recd 12.th March 1688 four Shillings of Joseph Williams for the Alienation of the with bargained Land from the within Name William Coale P Henry Hanslap Sher recorded the 20.th day of May 1769 This Indenture made this Seventeenth Day of May in the Year Seventeen hundred and Sixty Nine Between James Williams of Saint Marys County of the first Part Bennett Combs of of the same County of the second part and John Thomas of the same County of the third part whereas for the docking barring and extinguishing all Estates Tail and Reversions or Remainders thereupon expectant or depending of and in the Lands and Appurtenances herein after Mention'd the said (James) |
