(550) On the Back of the aforegoing Deed was thus Endorsed to wit Received on the Day and Year within written of the within named Thomas bond the sum of One hundred and thirty pounds Currency in full for the Consideration money Mentioned to be paid to us Philip Tippett Witness Alex.r Brown her Dan.l Cha.s Heath Elizabeth X Tippett Mark May 19.th 1769 Then came the within named Philip Tippett and Elizabeth his Wife before me one of his Lordships Justices of the provincial Court and Acknowledged the within Instrument of writeing to be their Act and Deed and the Land and premisses therein specifyed to be the Right and Estate of the within named Thomas Bond his heirs and Assigns according to the true intent and Meaning thereof Also Elizabeth the wife of him the said Philip being by me privately Examined Apart from and out of the hearing of her Said husband did repeat as above and also did further declare that she made this Acknowledgment of her own free will and accord without being induced thereto by threats of or ill usage from her said Husband or for fear of his Displeasure Dan of S.t Tho.s Jenifer Recorded the 19.th Day of May 1769 Ex.d This Indenture made this first Day of May in the Year of our Lord one thousand seven hundred and Sixty nine between George Frasier Hawkins of Prince Georges County Gentleman of the one part and Benedict Calvert of Prince Georges 13 County Esquire and Thomas Johnson Junior of the City of Annapolis Attorney at Law of the other part Witnesseth that the said George Frasier Hawkins for and in Consideration of the sum of Four hundred pounds Sterling to him in hand paid by the said Benedict Calvert and Thomas Johnson Junior at or before the Sealing and Delivery of these presents the Receipt whereof he doth hereby Acknowledge and thereof and therefrom doth Acquit and Discharge the said Benedict Calvert and Thomas Johnson Junior their and each of their Heirs Executors Administrators and Assigns hath Given Granted bargained Sold aliened enfeoffed and Confirmed and by these presents Doth give grant bargain sell alien enfeoff and Confirm unto them the said Benedict Calvert and Thomas Johnson Junior all that Tract or Parcel of Land lying and being in Frederick County called The lost tomahock containing within the Outlines thereof two thousand two hundred and ninety Acres more or less except the Tract of Land called Long Acre Containing Seventy Seven Acres more or less which is included in the said outlines and except also one hundred and Fifty Acres of Land adjoining to the said Tract called Long Acre which are already conveyed or Agreed to be Conveyed by the said George Frasier Hawkins to one Henry Cook And also except one hundred and Fifty Acres part of the said Tract called The lost Tomahock already Conveyed or agreed to be Conveyed by him the said George Frasier Hawkins to one Charles Beatty Together with all Houses Buildings Gardens Orchards Ways Waters Water Courses Timber Timber Trees Woods Underwoods Oars Mines Minerals Stones and Fossils (Royal Mines Excepted) Improvements Advantages Priviledges and Appurtinances whatsoever on the same Tract of Land called The Lost Tomahock (except as before Excepted) being to the same belonging or in anywise Appertaining And the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every part and parcel thereof (except as before excepted) And all the Estate Right Title Interest Use Trust Property Claim and Demand whatsoever of him the said George Fraiser Hawkins of in and to the said Tract or Parcel of Land called The lost Tomahock and every part and parcel thereof (ecept as before excepted) To Have and To Hold one undivided moiety of the said Tract or Parcel of Land called The lost Tomahock (Except as before excepted) with its Rights Members and Appertinances to him the said Benedict Calvert his Heirs and Assigns to the Only Proper use and behoof of him the said Benedict Calvert his heirs and Assigns forever and to or for no Other Use Intent or Purpose whatsoever And To Have and to Hold the other undivided Moiety of the same Tract or Parcel of Land called the lost Tomahock (except as before excepted) To him the said Thomas Johnson junior his Heirs and Assigns tot he only proper Use and Behoof of him the said Thomas Johnson junior his Heirs (and) |
