(513) and also the Several Negroes in the said Deed of Mortgage Mentioned under the Proviso that in Case the said Benjamin Welsh his Heirs Executors & Administrators should well and truly Pay or cause to be paid unto the said John Brice his Executors Administrators or Assigns the Sum of five hundred and forty five Pounds Sterling Money of Great Britain with Legal Interest thereon by Good Bills of Exchange drawn on some responsible Merchant in London at thirty Days sight together with the Charge of drawing and recording the said Deed of Mortgage at or upon the tenth day of April which Should be in the year One thousand Seven hundred Sixty and Six then the said Deed of Mortgage Should be Void and of no Effect and the sid Benjamin Welsh for himself his Heirs Executors and Administrators did in and by the same Deed Covenant and Grant to & with the said John Brice his Heirs Executors Administrators and Assigns that he the sid Benjamin Welsh his Heirs Executors and Administrators the aforesaid Sum of five hundred and forty five Pounds Sterling Money of Great Britain with Legal Interest thereon by good Bills of Exchange drawn on Some responsible Merchant in London at thirty Days Sight together with the Charge of drawing and recording the said Deed of Mortgage at or upon the aforesaid tenth Day of April which Should be in the year Seventeen hundred and Sixty Six aforesaid Should and would well and truly Pay and Satisfy as by the said Deed of Mortgage duly Acknowledged and recorded in Ann Arundel County and also in the Provincial Court Land Records may more fully and at Large appear And Whereas the said Money or any Part thereof or any Part of the Interest thereon was not Paid agreeable to the said Condition whereby the Estate of the said John Brice in the Mortgaged Premisses became and was Absolute in Law And Whereas although the said Deed of Mortgage Mentioned to Convey the whole of the said Tract of Land Called Snowden and Welsh in defiance of William's and Clark and the whole of that Other Tract Called Bacon Hall yet the said John Welsh the Father was Seized of Part only of the said Tract Called Snowden and Welsh in Defiance of Williams and Clark and being so Seized and also Seized of the said Tract of Land called Bacon Hall by his Last Will in Writing devised in the following words I give and bequeath to my two Sons Thomas Welsh and Benjamin Welsh two Tracts of Land near the Eastern Branch of Potowmack in Prince Georges County the one Called the Defiance of William's and Clark the Other adjacent thereto called Bacon Hall Containing together about four hundred Acres to be Equally divided betwixt my said two Sons Thomas and Benjamin Severally To have and (to) |
