(443) Prince Georges County 22.d November 1766 Came James Frye and Acknowledged the within Instrument of Writing to be his Act and Deed & the within mentioned Land and Premisses to be the Right and Estate of the within mentioned Thomas Allein his heirs & Assignes forever before us two of his Lordships Justices for the County afores.d at same time Came Susannah Wife to the said James Frye who Being by us Pravatly Examin'd Acknowled her right of Dower in the within mentioned Lands and Premisses to be the right & Estate of Thomas Allein his heirs and Assignes forever and Declared she did the same Willingly & Freely without being Induced thereto through threats fear of or Ill usage by her said husband or fear of his Displeasure Jos.a Beall Chris.r Lowndes 1768 April 20.th Received Nine Shillings & five Pence Sterling as an alienation fine on the within Two hundred & thirty five Acres of Land for the use of Lord Baltimore J Hepburn Recorded 5.th September 1768 6 Sides here ends Alienation List x.d Maryland To witt Know all Men by these Presents that we Thomas Campbell of Benedict in Charles County and Archibald Campbell of Leonard Town in S.t Marys County and Province aforesaid Merchants are held and firmly Bound unto John Reeder Sen.r and William Kilgour of S.t Marys County aforesaid Merchants in the full and Just Sum of three hundred and Eight Pounds thirteen Shillings and Seven Pence Sterling to be Paid to the said John Reeder Sen.r and William Kilgour their certain Attorney Executors Administrators or Assigns to the which Payment well and truly to be made and done We bind ourselves our and each of our Heirs Executors & Administrators Jointly and Severally in and for the whole firmly by these presents Sealed with our Seals and dated this Twenty Second day of September Anno Seventeen hundred and Sixty Eight The Condition of the above Obligation is such that Whereas the aforesaid John Reeder Sen.r and William Kilgour did by their Joint Bond bearing date the thirty first day of October Anno Seventeen Hundred and Sixty five Stand Indebted unto the above Bound Thomas Campbell & C.o for Dealings at their Store at Benedict in the full and Just Sum of two hundred and thirty Nine thousand One Hundred and Eighty Pounds of Crop Tobacco bearing Legal Interest from said date for Failure of Payment And Whereas there remained unpaid of this Tobacco Debt the Sixth day of June Seventeen Hundred and Sixty Six Two Hundred and thirty one Thousand and Eighty two Pounds of Crop Tobacco which Sum Still remains unpaid together with the Interest from the said Sixth of June Seventeen hundred and Sixty Six and all the Costs of Suits brought for the same in the Provincial Court as by the Judgement of the said Court may appear and Whereas the said Thomas Campbell for himself and Company hath agreed to and with the aforesaid John Reeder Sen.r and William Kilgour in manner and Form following That is to say the said John Reeder Sen.r and William Kilgour having Struck off the Action they Brought in the Provincial Court against the aforesaid Thomas Campbell for the Sum of One hundred and fifty four Pounds Six Shillings and Nine Pence half Penny Sterling being a Ballance due upon his Bond to them for Part of the Consideration of their Tobacco Bond to him & C.o as aforesaid and having given Judgement as aforesaid for the Tobacco Debt Interest & Costs due from them to the said Company And the said Thomas Campbell having for himself and C.o Consented to Stay Execution upon the Judgement aforesaid untill this first day of August next ensuing the date hereof Viz.t Anno Seventeen hundred and Sixty Nine And further if all the Costs of Suits aforesaid and one full third Part of the Tobacco Principal and (Interest) |
