(435) On the Back of the aforegoing Bond was thus Indorsed to wit I hereby Assign over the within Bond and all my Right and Title to the one half of the Lands within mentioned to M.r John Ray his Heirs Executors and Administrators and do give him full power and Authority to Sue in my Name if Necessary for Compelling Compliance therewith Witness my Hand this 25.th Day of August 1768 Thomas Linthicum Test Sam.l Middleton J Duckett Jur Recorded the 26.th August 1768 5 sides Ex.d Know all Men by these presents that I Thomas Linthicumb of Ann Arundel County Planter am held and firmly Bound unto John Ray of the said County in the just and full Sum of two Hundred Pounds Sterling Money of Great Britain to be paid to the said John Ray his Heirs Executors Administrators or Assigns to which payment well and truly to be made and Done I bind myself my Heirs Executors Administrators and Assigns in the whole and for the whole firmly by these Presents Sealed with my Seal and Dated this twenty fifth Day of August Anno Domini One thousand Seven Hundred and Sixty eight Whereas the above Bound Thomas Linthicumb hath by Deed Bearing Date herewith bargained and Sold to the said John Ray Part of a Tract of land lying and being in Ann Arundel County afoersaid called Bite the Biter for and in Consideration of the Sum of one HUndred and Seventy Pounds Current Money Now the Condition of the above Obligation is such that if hereafter it should turn out that the said Thomas Linthicumb was not at the Time of Executing the said Deed lawfully seized of the said Land of and in a good sure Absolute and indefeazable Estate of Inheritance free and Clear of all Conditions Limitations and Incumbrances whatsoever and the said John Ray shall thereupon be evicted or ejected for want of Title by virtue of the said Bargain and Sale and the said Thomas Linthicumb shall well and truly Save Harmless the aforesaid John Ray and refund and pay to him the said John Ray his Executors Administrators or Assigns the aforesaid Consideration Money together with all Costs Damages and Charges that may accrue to the said John Ray for any Buildings or other Improvements made upon the said Land by the said John Ray in Consequence of the Purchase aforesaid then the above Obligation to be void and of none Effect Else to be and remain in full Force and virtue in Law Signed Sealed and Delivered Thomas Linthicum (Seal) 2 sides in the presence of Sam.l Middleton Jn Duckett Ju.r Recorded 26.th Aug.t 1768 Ex.d This Indenture Made this twenty fifth Day of August in the year of our Lord one thousand Seven Hundred and Sixty eight Between Thomas Linthicumb of Ann Arundel County in the Province of Maryland Planter of the one Part and John Ray of the said County Planter of the other Part Witnesseth that the said Thomas Linthicumb for and in Consideration of the Sum of One |
