(434) John Hammond his heirs and Assigns forever and at the same time came Cassandra the Wife of the said Thomas Linthicumb who being privately Examined and out of the hearing of her said Husband Declared that She gave up all her Right and Title and Interest of in and to the sid Land and Premises unto the above Named John hammond his heirs and Assigns freely and Willingly and with out the fear of the threats or Displeasure of her said Husband agreeable to the true Intent and meaning of the said Deed and the Act of Assembly in such Case Made and provided Reverdy Ghiselin Rob.t Couden I have Received Seven Shillings and one penny Ster.g for Alienation fine on the within land this 26.th August 1768 Bennet Allen Recorded the 26.th August 1768 6¾ Examined Know all Men by these Presents that I Samuel Gaither of Ann Arundel County in the Province Duty paid of Maryland Innholder am held and firmly bound unto Mary and Cassandra Gaither in John Brice Cl the full and Just Sum of Six Hundred pounds Sterling to be paid unto the said mary and Cassandra their Certain Attorney Executors Administrators or Assigns to the which payment well and truly to be made and done I Bind myself my Heirs Executors ^and^ Administrators in the whole and for the whole firmly by these presents Sealed with my Seal and dated the thirtieth day of November Anno Domini One thousand Seven hundred and sixty one The Condition of this Obligation is such that if the above bounden Samuel Gaither his heirs or Assigns doth Convey and make over by Good Deed of Conveyance for himself his Heirs and Assigns a Certain Tract of Land Called Bite the Biter Containing three Hundred and fifty Acres of land and the said Samuel his Wife Acknowledge her Dowry which was devised to him by his late Father Benjamin Gaither deceased his last Will and Testament on his being made a Tender to him of a good Conveyance made and properly executed by the said Mary and Cassandra or their Heirs or Assigns of a Tract or parcel of a Tract of Land Lying in Frederick County Clear of all Incumbrances Containing three hundred and fifty five Acres More or Less Called and known By the Name of Gaithers Chance being that part of said Tract of Land Devised to said Mary and Cassandra by the said Benjamin Gaither their said late Father deceased and which said Land is in full Satisfaction and Payment to the said Samuel for the said Land so devised to him as aforesaid and that the same is shall and may be Deemed Adjudged and taken Between the Obligor and Obligees aforesaid as mutual Exchange of the Lands aforesaid from and to each other Nevertheless in Case the said Samuel Gaither his heirs or Assigns shall on or before the first day of May next Tender the Deed aforesaid then this Obligation to be void otherwise to remain in full force and virtue in Law Samuel Gaither (seal) Signed Sealed and Delivered with the Words (for himself Between the first & second line and the Words Between the third and fourth Line (and the said Samuel his Wife Acknowledge her Dowry) being first interlined in presence of us Alex.r Warfield John Ray |
