(429) shall or may arise from the Sale aforesaid Shall fall Short of the aforesaid sum of money To Wit the said Sum of One hundred and Seventy five pounds thirteen Shillings Current Money with Legal Interest as aforesaid In Witness whereof the said Thomas Gordon hath hereunto set his hand and Seal the date above written Signed Sealed and Delivered in the Tho.s Gordon (Seal) Presence of J Rogers On the back of the Aforegoing Deed was thus Endorsed viz.t Received the twenty seventh day of April Anno Domini Seventeen hundred and sixty eight of and from the within named Richard Henderson the Sum of one hundred and Seventy five pounds thirteen Shillings Current money being the Consideration within mentioned I say received by me Test Tho.s Gordon J Rogers Prince Georges County in the province of Maryland fs.t Be it Remembered that on the twenty seventh day of April Anno Domini Seventeen hundred and sixty eight before me the Subscriber one of his Lordships Justices of the Provincial Court Personally appeared Thomas Gordon party to the within Instrument of writing and Acknowledged the same to be his Act & Deed and the Lands and Premisses therein mentioned to be the Right and Estate of the within named Richard Henderson his heirs and Assigns according to the intent and meaning of the same Deed and the Acts of Assembly for such cases made and Provided Recorded the 12.th August 1768 taken before J Hepburn 10½ sides Ex.d This Indenture made this Tenth day of August in the year of our Lord One thousand Seven Hundred and sixty eight Between John Hammond Dorsey of Baltimore County Merchant of the one part and John Buchanan of the City of London Merchant of the other part Whereas a Certain Robert Adair and he the said John Hammond Dorsey by their Certain Writing Obligatory on or about the Seventh day of August Seventeen Hundred and sixty six acknowledged themselves to Be held and firmly Bound unto him the said John Buchanan in the Sum of four thousand eight hundred and sixty seven pounds thirteen Shillings and four pence Sterling with Condition thereto that if the said Robert Adair and John Hammond Dorsey did and should well and truly pay or cause to be paid unto the said John Buchanan his certain Attorney Executors Administrators or Assigns the just and full Sum of Two thousand four Hundred and thirty three Pounds thirteen Shillings and eight Pence Sterling at or upon the first Day of February then next ensuing the Date thereof with Legal Interest for the same then the said Obligation Should be void else to remain in Force and virtue in Law as by the said Writing Obligatory and Condition thereto may more fully appear And Whereas on the Seventh Day of this Instant August there did remain due and unpaid upon the said Bond the Sum of two Thousand and Seventeen Pounds five Shillings and Eleven pence sterling after discounting and deducting the Payments made on the said Bond which have been |
