309 said Provincial Court at Annapolis in the Name of the said Thomas Johnson Junior as plaintiff or Demandant against the said Richard Henderson as Tenant whereby the said Thomas Johnson Junior shall demand against the said Richard Henderson the said Lands and other the premisses hereby released with their Appurtenances by such apt and convenient Names and Descriptions as shall be proper in that Behalf to which Writ the said Richard Henderson shall appear Gratis in his own proper person or by his Attorney or Attornies lawfully authorized and shall and will vouch or call to warrant the same premisses the said William Edmonston who shall also appear Gratis in his own proper person or by his Attorney or Attornies lawfully Authorized and shall and will enter into the said Warranty and vouch over to Warranty the same premisses the Common Vouchee who shall thereupon appear and enter into the said Warranty and after Imparlance make Default and such further and other proceedings be had upon the said Writ and all the said parties shall so demean themselves therein that one good and perfect Common Recovery with double voucher shall or may be had suffered ^perfected^ and executed of for or upon all and singular the said hereby released premisses with their Appurtenances in all things according to the usual Course order and Form of Common Recoveries with double voucher for Assurance of Lands in such cases used And it is further covenanted concluded declared and fully agreed by and between all the said parties to these presents for themselves and their Heirs and it is their true intent and meaning that the said Common Recovery so as aforesaid or in any other manner to be had suffered or executed of for or upon the said hereby released premisses or any part thereof and the Full Force Effect and execution thereof and also all and every other Common Recovery and Recoveries and other Assurances had made levied suffered or executed or to be had made levied suffered or executed of for or upon the Premisses or any part thereof to which the said parties to these presents or any of them is or are or shall be parties or party or privy shall be and enure and shall be construed expounded deemed and taken to be and enure to the only proper use and Behoof of the said Richard Henderson his Heirs and Assigns for ever and to or for no other use intent or purpose whatsoever In Witness whereof the parties to these presents have hereunto interchangeably set their Hands and Affixed their seals the Day and Year first above written his Signed Sealed and Delivered William X Edmonston (seal) In the presence of Mark sides R.d Henderson (seal) James Marshall J Rogers Tho.s Johnson Jun.r (seal) Reced on the Day and Year first within written of and from the within named Richard Henderson the sum of fifty Pounds Current Money being the consideration within mentioned to be by him paid to me I say received by his William X Edmonston Witness James Marshall J Rogers Mark |
