(303) Oct.r 20.th 1767 Received of the within Charles Carroll the sum of twenty shillings Sterling Money being the Consideration within mentioned to be paid by him to me Test Ja Tilghman 3.d H Carroll Oct.r 20.th 1767 Then came before me the Subscriber one of his Lordships Justices of the Provincial Court the aforenamed Henry Carroll and Araminta his Wife and Acknowledged the within Instrument of writing to be their Act and Deed and the Lands and premisses therein Specified to be the right and Estate of the aforenamed Charles Carroll his Heirs and Assigns According to the True intent and meaning of the said Deed also Araminta the wife of him the said Henry Carroll being by me privately Examined apart from and out of the hearing of her said Husband did repeat as above and at the same time did declare that she made this Acknowledgment of her own voluntary free will and accord without threats or Compulsion from her said Husband or fear of his displeasure 12 sides John Darnall Recorded the 21.st Day of October 1767 Ex.d This Indenture made this first Day of September in the Year of our Lord one thousand seven hundred and sixty seven between William Husbands the Elder of Cæcil County in the Province of Maryland Planter of the one part and Benjamin Rumsey of Charles Town in the County and Province aforesaid Attorney at Law of the other part Witnesseth that it is covenanted concluded granted and agreed on by and between the parties to these presents And the said William Husband for himself his Heirs Executors and Administrators doth covenant grant and agree to and with the said Benjamin Rumsey and his Heirs by these presents that he the said William Husband shall and will before the end of next October Provincial Court ensuing permitt and suffer the said Benjamin Rumsey to sue forth and prosecute against him the said William Husband one Writ of Entry upon a Disseisin in le post returnable before the Right Honourable the Lord Proprietary's Provincial Justices at the City of Annapolis thereby demanding against the said William Husband all that four Hundred and fifty Acres of Plantable Land situate lying and being in Cæcil County aforesaid Begining on the South side of a Creek called Connawango Creek runing into Susquehanna River at a Bounded Beach standing on a Hill near the said Creek side and runing across a Stony Neck for Breadth South South West fifty perches then by a line North sixty five Degrees Easterly five hundred and forty five perches then North North West two hundred and fourteen perches then runing South West one third Westerly to the first mentioned Beach Tree containing four hundred and fifty Acres with all and every the Appurtenances by such Name and Names Number of Acres Quantities Qualities Terms and Descriptions in the said Writ to be contained and in such manner and form as by Counsel learned in the Law shall be devised advised or required unto and upon which said Writ of Entry the said William Husband shall appear Gratis and vouch to warranty the common Vouchee who shall likewise appear Gratis and enter freely into the warranty and afterwards make Default and Depart in Contempt of the Court so that Judgment may be thereupon had and given for the same Benjamin Rumsey (to) |
