(302) Messuages Farms Lands Tenements Hereditaments and Premisses To the end that one or more good and perfect Recovery or Recoveries in the Name of Common Recoveries for Assurance of Lands may in due form of the Law be had suffered levied and perfected of all and singular the said Messuages Farms Lands Tenements Hereditaments and Premisses with their and every of their Appurtenances And for that end and purpose it is agreed by all the said parties to these presents that it shall and may be lawfull to and for the said John Hall at the Costs and Charges of him the said Henry Carroll and Araminta his wife to sue out at the next October Provincial Court one or more writ or writs of Entry Sur Disseisin in le Post against him the said Charles Carroll in the name of him the said John Hall as Plaintiff or Demandant therein of and for the afs.d several Messuages Farms Lands Tenements Hereditaments and all and singular the Premisses with their and every of their Appurtenances by such apt and Convenient Names Numbers Quantities Qualities and descriptions as shall be thought fit and requisite and unto which said writ or writs the said Charles Carroll shall appear Gratis in his proper person or by his Attorney for that purpose lawfully constituted and shall vouch to warranty the said Henry Carroll and Araminta his wife who shall appear Gratis and enter into the said warranty and vouch over the common Vouchee and all such further and other proceedings shall be had therein as are usual and requisite for the suffering and perfecting of Common Recoveries for Assurance of Lands And it is hereby declared by all the said Parties to these presents and the true intent and meaning of them and every of them and of these presents that the said Common Recovery and every other Common Recovery to be had of the same Premisses or of any prat thereof in manner afs.d or in any other manner and all and every Recoveror and Recoverors in such Common Recovery and his and their Heirs shall stand and be seised thereof to and for the use of them the said Henry Carroll and Araminta his wife their Heirs and Assigns in case the said Henry Carroll and Araminta Carroll shall by Deed executed in their Life times bargain sell Convey or Exchange the same Lands and Premisses to any person or persons whatsoever for valuable consideration but in case no such Bargain Sale Conveyance or Exchange be made as aforesaid then to stand and be seised of the Lands and premisses aforesaid and every part and parcel thereof to and for the use of them the said Henry Carroll and Araminta Carroll for and During the Term of their Natural Lives and the Life of the Survivor of them and after their Decease then to and for the use of Henry James Carroll eldest son of the said Henry and Araminta and the Heirs of his Body lawfull begotten and for default of such Heirs then to the use of the Heirs of the Bodies of the said Henry and Araminta begotten and for default of such Heirs then to and for the use of the Right Heirs of the said Araminta for Ever and to or for no other use intent or purpose whatsoever In Witness whereof the parties to these presents have hereunto sett their Hands seals the Day and Year first afsaid Signed Sealed and Delivered H Carroll (seal) in the presents of us Araminta Carroll (seal) Ja Tilghman 3.d Char Carroll of Carrolton (seal) J Hall (seal) To which aforegoing Deed were Annexed the following Endorsments (viz.t) |
