(304) To recover the said Land Premisses and Tenements with the Appurtenances against the said William Husband and for the said William Husband to recover over in value against the common vouchee to the end that one perfect common Recovery with single voucher may be thereupon had and suffered and all and every other thing and things be done and perfected needful and convenient for the having and suffering the same Recovery according to the Cause of common Recoveries in such cases used and the same Recovery also is to be Executed by one Writ of habere facias Seisinam accordingly And it is further covenanted concluded granted and Agreed by and between the parties to these presents and the said William Husbands for himself and his heirs and the said Benjamin Rumsey for him self and his Heirs that he the said Recovery shall be had and suffered as aforesaid before the end of the October Provincial Court next ensuing and that the said Recovery so as aforesaid or in any other wise to be had or suffered of the said Land premisses or Tenements with the Appurtenances and the Execution thereupon shall be deemed adjudged and taken and is meant intended and by these presents is hereby declared to be and enure and the full force Effect and virtue of the same shall be and enure and the said Benjamin Rumsey and his Heirs from and immediately after suffering the same and the Execution thereof had and made shall stand and be seised of all and singular the Lands premisses and Tenements aforesaid with the Appurtenances and every part and parcel thereof to and for the only proper use benefit and Behoof of the said William Husband his Heirs and Assigns for ever and to and for none other use Intent and purpose whatsoever In Witness whereof the parties to these presents have hereunto sett their Hands and seals the Day and year first above written William Husband (sea) 6 sides Sealed and Delivered Benjamin Rumsey (sea) in the presence of W.m Husband J.r John Ross Recorded the 22.d Day of October 1767 Ex.d This Indenture made this twenty second Day of October in the Year seventeen hundred and sixty seven Between Elias Clark of the one part and Samuel Adams of the other part Whereas for the docking barring and extinguishing all Estates Tail and Reversions or Remainders thereupon expectant or depending of and in the Lands and Appurtenances herein after mentioned the said Elias Clark as Demandant did heretofore (at the request Cost and Charges of the aforesaid Samuel Adams) (prosecute) |
