279 to appear in person upon the return of the said Writ of Entry before the Justices of the same Courts or any of them or upon the warranty aforesaid Now Know Ye that the s.d Frederick Lord Baltimore hath made Ordained Nominated Constituted and appointed and in his place and stead put and deputed and by these presents doth make Ordain Nominate Constitute and appoint and in his place and stead put and depute the Honourable Goldsborough of the said Province Esq.r and Attorney General of the same Province or the Attorney General of the same Province for the time being to be his true and lawfull Attorney for him and in his name place stead and behalf to appear before the Justices or Magistrates of the respective Provincial or County Courts or other proper Courts in the s.d Province and all other Judicatures Ordinary and Extraordinary and at all times and places in the said Province upon all and every writs or writ of Entry Sur Disseisin en le Post or other Writs or Process whatsoever which shall or may be sued forth or prosecuted by the said Walter Dulany or his heirs against the said Bennett Allen or his heirs for the purpose of Demanding the said Manor Tract or District of Land Called Ann Arundel Manor and other the Manors or reserved Lands Tracts or Districts of Land Tenements and Hereditts and other the premisses by the said in part recited Indentures of Lease and Release mentioned to be granted and Released or intended so to be and also upon all & every warranty in which the said Frederick Lord Baltimore shall be vouched over by the said Bennett Allen or his heirs touching the said Manors and Premisses every or any of them and for all or any the purposes in the said recited Indentures expressed and also For and in the name and behalf of him the said Frederick Lord Baltimore to enter into warranty and vouch over the Common Vouchee and in all things so to behave and demean himself therein as the said Frederick Lord Baltimore might or could do if personally present and so that one or more perfect Common Recovery or Recoverys wherein the said Frederick Lord Baltimore shall be vouched shall and may be had and suffered of the said Manor called Ann Arundel Manor and all other the Manors and premisses mentioned to be granted by the said Indentures of Lease and Release or intended so to be according to the usual Course in the said Province of Common Recoverys with double voucher for Assurance of Lands in such Cases |
