(268) at his Death And whereas the said Frederick Lord Baltimore did by his Commission or Instrument in writing under his hand and Lesser Seal at Arms dated at London the seventy first day of February in the year of our Lord one thousand seven hundred and sixty six directed to his Trusty and well beloved Horatio Sharpe Lieutenant Governor of the said Province of Maryland the Honourable Daniel Dulany Esquire and John Morton Jordan Esquire Give full power and Authority unto them the said Horatio Sharpe Daniel Dulany and John Morton Jordan and the Survivors and Survivor of them for him and in his name to Grant sell and dispose or otherwise to Treat Contract and agree for the Granting setling and disposing of all or any his reserved Lands or Manors in the said Province as well Cultivated as uncultivated in such manner as therein mentioned with power to execute all proper Deeds Conveyances and Assureances and to receive the Consideration Money and with such other powers as are therein more particularly mentioned And Whereas by certain Instructions Issued under the hands and Lesser Seal at Arms of the said Frederick Lord Baltimore addressed to the said Horatio Sharpe Daniel Dulany and John Morton Jordan and bearing date on or about the eighth day of November in the said Year one thousand seven hundred and sixty six after a recital that Doubts might arise touching his Lordships title to Ann Arundel Manor in the said Province on account of a Devise made by the said Charles last Lord Baltimore though Tenant for life only by virtue of his said Marriage Settlement of the said Manor to Benedict Calvert Esquire which power was afterwards Defeated by the said Frederick Lord Baltimore upon his Attaining the age of twenty one Years by exercising the powers in him vested as Tenant in Tail of the said province as aforesaid the said Frederick Lord Baltimore to Obviate any unneccessary scruples which uninformed purchasers might be Induced to Entertain of his Title did Authorize and Empower them upon the sale of the said Manor or any the Lands thereto belonging to incertin the Grants to be thereof respectively made proper Engagements and Stipulations on his behalf to warrant the title of the Lands to be so Granted against the said Benedict Calvert his heirs and Assigns and all other persons Claiming or to Claim under him or them but under such restrictions as therein mentioned as in and by the said Commission and Instructions (relation) |
