(260) in manner herein after mentioned Now this Indenture witnesseth that for the docking and barring of all Estates Tail of and in the said Tract of Land with the Appurtenances and all Reversions and Remainders thereupon expectant or depending and establishing fixing and ascertaining the Division of the said Tract of Land so that the part of each of the said Thomas Hammond and Rebecca the wife of the said James Kelso may be forever hereafter had and held in severalty and for Settling the said premisses with the Appurtenances to for and upon the uses Intents and purposes herein after mentioned expressed and declared And for and in Consideration of five Shillings current money by the said William Reynolds to them the said Thomas Hammond and James Kelso and Rebecca his wife in hand paid at or before the sealing and Delivery of these presents the Receipt whereof is hereby acknowledged and for other good causes and considerations hereunto moving They the said Thomas Hammond and James Kelso and Rebecca his wife Have and each of them Hath granted bargained and Sold And by these presents Do and each of them Doth grant bargain and Sell unto the aforesaid William Reynolds and his heirs All that the aforesaid Tract or parcel of Land called Duck Cove Together with all Houses Buildings Gardens Orchards woods underwoods ways waters water courses priviledges Improvements Advantages and Appurtenances whatsoever to the same belonging or in any wise Appertaining And the Reversion and Reversions Remainder and Remainders Rents Issues and profits thereof and of every Part and parcel thereof and all the Estate Right Title Interest Claim and Demand whatsoever of them the said Thomas Hammond and James Kelso and Rebecca his wife and each of them of in to or out of the said Premisses with the Appurtenances or any part or parcel thereof in any wise howsoever To have and to hold the said Tract or parcel of Land and all and Singular other the premisses with their Appurtenances unto him the said William Reynolds his heirs and Assigns to the use and Behoof of him the said William Reynolds his heirs and Assigns forever Yet nevertheless to the Intent that by virtue of these presents he the said William Reynolds may become a good and perfect Tenant of the immediate Freehold and Inheritance of the said Tract or parcel of Land with it's Appurtenances against whom a common Recovery may be had perfected and executed in Such manner as is herein after mentioned and for that purpose it is covenanted concluded and agreed by and between all the said parties to these presents that before the End of May Provincial Term Seventeen hundred and Sixty Seven at the proper Costs and Charges of the said Thomas Hammond and James Kelso one writ of Entry sur Disseisin enle |
