(221) Indenture dated the Day next before the Day of the Date of these presents for one year from the Day next before the Day of the Date of the said Indenture in consideration of five Shillings Sterling to him in hand paid and by force of the Statute for transferring uses into possession) and to his Heirs All that tract or parcell of Land called Ashmans Hope Situate lying and being in Baltimore County aforesaid containing three hundred and twelve acres save and except so much thereof as is in the possession of a certain Thomas Harrison And the Reversion and Reversions Remainder and Remainders Rents Issues and Profits of all and Singular the said premisses with its Rights Members and Appurtenances and all the Estate Right Title Interest Claim and Demand of him the said George Ashman of into or out of the said hereby released premisses with the appurtenances and every part thereof To have and To hold the said Tract or parcell of Land except as before excepted and all and Singular the premisses with the appurtenances unto the said Robert Alexander his heirs and assigns To the Intent and purpose that by virtue of the said Indenture of Bargain and Sale and of these present he the said Robert Alexander may be and become a good and perfect Tenant of the immediate Freehold and Inheritance of all and Singular the said hereby released premisses with their Appurtenances against whom a common Recovery may be had perfected and executed in such manner as is herein after mentioned And for that purpose it is covenanted concluded and agreed by and between all the said parties to these presents that at the proper costs and charges of the said George Ashman one writ of Entry sur Disseisin en le post shall or may be brought commenced or prosecuted returnable before his Lordships Justices of the Provincial Court to be held at Annapolis the third Tuesday of May next in the name of the said Joseph Nicholson as Demandant or plaintiff against the said Robert Alexander as Tenant whereby the said Joseph Nicholson shall remand against the said Robert Alexander the said Tract or parcel of Land except as before excepted with the Appurtenances by such apt and convenient names and Descriptions as shall be proper in that behalf to which Writ the said Robert Alexander shall appear gratis in his own proper person or by his attorney or attornies lawfully authorized and Shall and will vouch or call to warranty the same premisses the said George Ashman who shall appear gratis in his proper person or by attorney lawfully authorized and Shall and will enter into the said warranty and vouch over to warrant the Same premisses the common vouchee who Shall thereupon appear and enter into the said warranty and after Imparlance make Default and such further or other proceedings be had upon the said writ and all the said parties Shall be demean themselves therein that one good and perfect common Recovery with double voucher shall or may be had suffered perfected and executed of for or upon all and singular the said hereby released premisses with their appurtenances in all Things according to the usual Course Order and Form of common Recoveries with double voucher for Assurance of Lands in such cases used And it is further covenanted concluded declared and fully agreed by and between all the said parties to these presents for themselves and their Heirs and it is their true Intent and meaning that the said common Recovery so as aforesaid or in any other manner |
