as joint Merchants afores.^d or otherways due & owing to them
        jointly, whether by Judgment, Bonds, single Bills, Notes, Orders
        or Book Accounts or otherways how soever & all interest due, and
        to grow due thereon, & also the several securities & Evidences of such
        Debts, To have hold receive take & enjoy all & singular the said
        hereby bargained, sold & assigned premisses with their & sundry of
        their appurtenances unto the said George Maxwell his Heirs Executors
        Administrators & assigns as his & their proper Estate & to his & their
        separate sole & only use for ever and the said James Forbes for himself
        his Heirs Executors and Administrators doth hereby covenant promise
        & grant to & with the aforesaid George Maxwell his Heirs Executor
        Administrators & assigns in Manner & form following that is to say
        that he the said George Maxwell shall & may have hold & receive
        take and enjoy the said bargained sold & assigned premisses with their
        and every of their appurtenances to his separate sole & only use
        without any Manner of Account thereof or therefore to be made or
        rendered to him the said James Forbes his Executors or Administrators
        and also that the said James Forbes his Executors shall not, nor
        will receive or take any of the said Debts sums of Money or
        quantities of Tobacco, or other of the said bargained or assigned
        premisses; nor give or make any receipts or acquittances thereof
        or therefore of or for any or either of them  and further that he
        the said George Maxwell his Executors Administrators or Assigns
        shall & may sue implead & prosecute any person or persons
        whatsoever of, for, concerning, or touching the said Bargained
        or assigned premisses or any or either of them or for the recovery
        & receipt of any part thereof at his or their meer will & pleasure
        in the names of them the said George Maxwell & James Forbes
        or either of them as the case may require but at the sole cost
        of him the said George Maxwell his Executors Administrators
        or Assigns ^and that any recovery to be had in such suit or suits shall be to the sole & separate use of the afores.^d George Maxwell his Executors Administrators & assigns^ and likeways that he the said James Forbes his Heirs
        Executors Administrators or Assigns shall & will at any Time or
        times hereafter upon the reasonable request & at the cost & charges
