362 whereon Francis Hopewell formerly Built his Houses devised in Tail by William Heard deceased to his Grand Daughter Susannah Hopewell containing forty acres together with all Edifices Buildings Gardens Orchards Ways Waters Water Courses Commodities Priviledges Improvements Emoluments Advantages & Appurtenances whatsoever to the same part of the Tract of Land afores.d belonging or appurtaining and the Reversion and reversions Remainder and Remainders Rents Issues and Profits thereof and of every part and parcell thereof And also all the Estate right Tittle Interest Use Trust property Claim and Demand whatsoever of them the said Robert Fenwick and Susannah his Wife of into or out of the aforesaid part of the tract or parcell of Land aforesaid or any part thereof To have and To hold the said part of the Tract of parcell of Land aforesaid and every part and Parcells thereof and all and singular the Premisses with its rights Members and appurtenances to him the said Mark Heard his Heirs and Assigns To the intent and purpose that the said Mark Heard may be and become perfect Tenent of the Freehold and Inheritance of the said Premisses that a common recovery may be had and suffered against him in such Manner as is herein after mentioned And for that purpose it is hereby covenanted granted and agreed by and between all the parties to these presents that before the End of the next September Provincial Court one or more Writ or Writs of Entry sur Disseisin en le post at the costs and charges of him the said Mark Heard shall and may be brought and prosecuted against him the said Mark Heard in the name of him the |
