339 the said post standing in the place where formerly stood the beginning Tree of the said Tract and running thence up a branch or creek comonly called Clash otherwise Slash Creek south East One hundred and twenty five perches; then North East one hundred and twenty eight perches then North West one hundred and Twenty five perches to the given Line of the Original Tract, thence with the said given Line to the beginning post above mentioned with the appurtenances thereunto belonging To which said Writ the said James Marshall did appear in his proper person and Vouched to Warranty thereof the aforesaid John Tyler who did likewise appear Gratis in his proper person and did enter into the said warranty and Vouched over to warrant the same premisses the Common Vouchee who did thereupon appear and entered into the said Warranty and after Imparlance made Default and such further and other proceedings were therein so that a good and perfect common recovery with double Voucher was had suffered perfected and Executed in all things according to the usual form of common recoveries with double voucher for assurance of Land in such case used and accustomed Now this Indenture Witnesseth that for the setling and declaring the Intent use and purpose of the said Recovery so suffered as aforesaid and for and in consideration of five shillings Current Money by him the said James Marshall to the said John Tyler in hand paid the receipt whereof the said John Tyler doth |
