328 or conveyances assurance or assurances in the Law for the better securing and conveying the Lands and premisses afd to the said John Brice Esq.r in fee simple or to his Heirs or assigns as shall be by the said John Brice or his Heirs or assigns or by his or there Council Learned in the Law reasonably devised advised or required, In witness whereof the parties to these presents have hereunto interchangeably set their Hands and affixed their seals the day & year first above Written; signed sealed and delivered in presence of the words [by the province afd] & [Cecil] & afd] being first interlined, R Cruickshank, Jn.o Ecleston Hercules Coutts (s) On the Back of the aforegoing was thus written Receiv'd this 16th day of March 1763 of the within John Brice the sum of three hundred and Twenty pounds Current Money of Maryland in full consideration for the within Lands per me Hercules Coutts Witness R Cruickshank, Jn.o Eccleston Be it rememberd that on the 16th day of March in the Year of our Lord seventeen hundred and sixty three the within Hercules Coutts and Mary his Wife personally appeared before us the subscribers two of his Lordships Justices of of the Peace for Kent County in Maryland and acknowledged the within Deed to be their act and Deed and the Lands & premisses therein contained to be the only Right Title property & Estate of the within John Brice Esq.r according to the Form Force & Effect true Intent and Meaning of the same Deed and also that we Examined the said Mary out of the Hearing of her husband and she declared that she made her said acknowledgment & release of Dower in the said Lands willingly & freely and without being induced thereto by Fear or threats of ill usage from her said Husband or for fear of his Displeasure, In Testimony whereof we have hereunto set our hands the day & year above written Robert Cruickshank, Jn.o Eccleston (s) These are to Certify that the Worshipfull Robert Cruikshank and John Eccleston the persons takeing and subscribing the above acknowledgment of Hercules Coutts and Mary his Wife at the Time of taking and subscribing that acknowledgment were and still are two of his Lordships the right Honourable the Lord Proprietary his Justices of the County of Common Pleas for the County of Kent in the Province of Maryland duly commissioned and sworn and that to all such acknowledgments so taken before them due faith and credit is and ought to be given in Justice Court and thereout, In Testimony whereof I set my hand & affixed the public seal of the county afd this 23.d day of March 1763 Denis Dulany Cl S.t Coty 9 s.d Recorded the 4.th of April 1763 |
