210 Exam.d This Indenture made this seventeenth Day of April in the Year of Our Lord Seventeen hundred and sixty two Between Bartholomew Pomeroy and Joseph Janson surviving Assignee of John Philpot and John Hutchinson of London Bankrupts on the one Part and Thomas Rutland of Ann Arundel County in the Province of Maryland on the other part Witnesseth, Whereas Patrick Creagh late of the City of Annapolis in the said Province of Maryland Merchant deceased did in his Life Time by his Deed bearing Date on or about the sixteenth day of April in the Year of our Lord Seventeen Hundred and fifty four among other things convey and assure unto the said Bartholomew Pomeroy and Joseph Janson and their Heirs All those two Lots or Portions of Ground Numbers Ninety five & Ninety six, situate lying and being with the Appurtenances in the said City of Annapolis as by reference being had to the said Deed remaining among the ^Land^ Records of the Provincial Court of the said Province of Maryland may more fully appear And Whereas the Proviso or Condition in the said Deed contained was not performed or in any manner fulfilled by the said Patrick Creagh in his Life Time or [illegible] other person or Persons since his Decease and that all the [illegible] and things Lands and Tenements in the said Deed contained were in Value greatly short of the Money due from the said Patrick Creagh for which the said Deed or conveyance was Intended as a security by way of Mortgage And Whereas for the Raising such sum and sums of Money as |
