175 as aforesaid and also of the payments and advances which hereafter shall be made by the said James Marshall to or by the order of the said Francis King as aforesaid with legal interest thereon, as aforesaid first deducting thereout the necessary charges of such sale or sales and if the Money arising from such sale or sales shall be more than sufficient for the purpose aforesaid, the overplus shall pay to the said Francis King his Executors administrators or assigns And that the said James Marshall his Heirs Executors administrators or assigns shall not be chargeable or answerable to the said Francis King his Executors administrators or assigns for any More of the Money or Tobacco arrising from such sale or sales than shall be actually received by the said James Marshall his Heirs Executors administrators or Assigns IN witness whereof the parties to these presents have hereunto interchangeably set their Hands and affixed their seals the day & year first above Written Francis King (s) Signed Sealed and Delivered in the presence of W Digges On the Back of the foregoing John Darnall Indenture was thus written Received on the Day and Year first within written of and from the Within named James Marshall the within mentioned sum of five shillings sterling Money being part of the Consideration Within mentioned to be by him paid to me I say receivd by me Francis King |
