x.d  This Indenture Tripartite made this Ninth day of September
       in the Year of our Lord One thousand Seven hundred and Sixty one Between
       James Tilghman of Talbot County Attry at Law of the one Part James Berry
       Son and Heir of William Berry late of Kent County upon Delaware deceased of
       the Second Part and Peter Webb of Talbot County Planter of the third part
       Whereas the said James Tilghman did at the Provincial Court held at
       Annapolis the Second Tuesday in September Instant upon a Writ of
       Entry Sur Disseisin en le Post before the Justices of the Same Court recover
       by common Recovery usual in Such Cases against the Said Peter Webb
       One hundred and fifty Acres of Plantable Land being the Lowermost Moiety
       of a Tract of Land lying in Talbot County afd called Ridley with the
       Appurtenances in which Recovery the said Peter Webb did Vouch to
       Warranty the Said James Berry who Vouched over the Common Vouchee
       who appeared and entered into Warranty and after defence made departed
       in Contempt of the Court and made Default whereby a good and Perfect
       Common Recovery with Double Voucher was had of the Lands afd with
       the Appurtenances as by the Record thereof in the said Court now
       remaining at Annapolis afd may more at Large appear  Now
       this Indenture Witnesseth and it is hereby declared that the
       true intent meaning and design of all the Partys to the said Recovery and
       to these Presents was and was Declared to be at the Time of Suffering the same
       and still is that the said Recovery and the Execution thereof should be and
       Enure and be Construed Judged and taken to be and Enure and that the
       Recoverer thereof and his Heirs should from thence forth stand and be seized
       of and in the recovered Premisses with the Appurtenances to the only
       proper use and Behoof of the said Peter Webb his Heirs and Assigns
       for ever and to no other use intent or purpose whatsoever  In Witness
       whereof the Parties to these Presents have thereunto interchangeably
       put their Hands & Seals the day and year first above written
