(349) of Land and every part thereof To have and to hold the same Two Tracts or parcels of Land and Premisses with their and each of their Rights Members and Appurtenances unto him the said Richard Maccubbin his Heirs and Assigns to the intent and purpose that the said Richard Maccubbin may be perfect Tenant of the Freehold of the said Premisses that a Common Recovery may be had and Suffered against the said Richard Maccubbin in this present Provincial Term and it is hereby declared by and between the Parties to these Presents that whatsoever Common Recovery or Recoverys is are or shall be had and Suffered during the present Term or any other Provincial Court shall be deemed construed and taken to be and Enure to and for the use and Behoof of him the said Thomas Rutland his Heirs and Assigns for ever and to or for no other use intent or purpose whatsoever In Testimoney whereof the parties to these presents have hereunto Set their Hands and Seals the Day and Year first within written Signed Sealed and Delivered Tho.s Rutland (seal) In the presence of us the word (Enlarged) being first interlined Leonard Wayman (seal) also the Name (Thomas Sappington) being three Times interlined Leon.d Wayman Jun.r (seal) J Hall Tho.s Williamson Tho.s Sappington (seal) Stephen Stewart (seal) On the Back of the aforegoing Deed was thus Written to wit 18th Sep.r 1761 Then Came before me the Subscriber one of his Lordships Justices of the Provincial Court the within named Thomas Rutland Leonard Wayman Sen.r Leonard Wayman Jun.r Thomas Sappington and Stephen Stewart and acknowledged the within instrument of writing to be their Act and Deed and the Lands and Premisses therein Specified to be the right and Estate of the within named Richard Maccubbin his Heirs and Assigns according to the true Intent and Meaning thereof Recorded 18th Sep.r 1761 Geo Steuart 7½ s.ds |
