       and Purpose that the said David Downie may be and become perfect Tenant
       of the Freehold and Inheritance of the said Premisses that a Common Recovery
       may be had and Suffered against him in such Manner as is herein after
       mentioned And for that Purpose it is hereby covenanted granted and agreed
       by and between all the said Parties to these presents that before the End of the
       next ^April^ Provincial Court one or more Writ or Writs of Entry Sur Disseisin en le Post
       shall and may be brought and Prosecuted by and in the name of him the said
       James Forbes as Plaintiff or Demandant against him the said David Downie
       as Tenant or Defendant of and for the aforesaid Tract or Parcel of Land and
       Premisses with the Appurtenances by Such Name or Names Quantity Quality
       Number or Content of Acres or other Certainties and Discriptions as shall be apt and
       Convenient in that behalf To which Writ or Writs the Said David Downie shall
       Appear gratis in his proper Person or by his Attorney or Attorneys lawfully
       authorized and shall Vouch to Warrant the Premisses the Said Dryden Forbes who
       Shall likewise appear gratis in her Proper person or by attorney or attorneys
       lawfully authorized and shall and will Enter into the said Warranty and
       after Imparlance make Default and such further and other Proceedings
       Shall be therein so that one or more good and Perfect Common Recovery
       or Recoverys with Double Voucher shall and may be had Suffered and perfected
       and executed in all things according to the usual form of Common Recoverys
       with Double Voucher for Assurance of Lands in Such Cases used and accustomed
       And it is hereby further Covenanted granted Concluded Declared and fully
       agreed by and between all the Said Parties to these Presents that from and
       after the Suffering and perfecting the said Recovery or Recoveryes as well
       these Presents and the Assurance ^hereby^ made as also the Common Recovery
       or Recoverys so as aforesaid or in any other Manner to be had Suffered
       and perfected shall be and Enure and shall be adjudged construed deemed
       and taken and are and were Meant and intended and are hereby
       declared to be and Enure to the Recoveror or Recoverors in the said Recovery
       or Recoverys named or to be named and he and they and his and their Heirs
       Shall stand and be Seized of the Tract or Parcel of Land aforesaid and Premisses
