(265) the said Thomas Norris may be and become a good and perfect Tenant of the immediate Freehold and Inheritance of all and Singular the said Premisses against whom one or more common recovery or recoveries may be had and perfected and extended to the use intent and Purpose herein after Mentioned expressed and declared and to or for no other use Intent or Purpose whatsoever and thereupon it is covenanted Concluded and Agreed by and between all the said Parties to these Presents that before the end of the next Provincial Court one or more Writ or Writs of Entry sur disseisin en le post shall and may be brought and Prosecuted against the said Thomas Norris ^as^ Tenant ^or Defendant^ of and for the aforesaid Tract or parcel of Land and Premisses with the Appurtenances by such Name or Names Quantity or Content of Acres or such other certainties or discriptions as shall be apt and convenient in that behalf to which Writ or Writs the said Thomas Norris shall appear gratis in his own proper Person or by Attorney Properly Authorized and shall and will vouch to Warrant the Premisses the said Samuel Maccubbin who shall likewise appear in his proper person or by Attorney properly Authorize and shall Vouch to Warranty the Common Vouchee and such further and other Proceedings shall be therein had so that one or more good and perfect common recovery or Recoveries with double Voucher shall and may be had perfected and executed in all things according to the Usual form of common recoveries with double Voucher for Assurance of Lands in such case used and accustomed And it is further covenanted agreed and declared by and between all the said Parties to these Presents that such recovery or recoverys so as afsd or in any other manner to be suffered executed and perfected whereto the Parties to these presents or any or any of them are or shall be parties of or concerning the Premisses shall be and Enure and shall be adjudged construed deemed and taken to be and Enure and the said Robert Alexander and his Heirs and all and every other Person and Persons which shall then or any Time thereafter stand seized of the Premisses or of any Part thereof by virtue of these Presents or of the said recovery or recoveries shall so stand and be seized thereof and of every part thereof to the only proper Use and Behoof of the said Thomas Norris his Heirs and Assigns for ever In Witness the Parties to these Presents have hereunto interchangeably set their Hands and Seals the Day and Year first above written |
