(174) in Law as by the said last recited Indenture of Mortgage or Instrument of Writing duly executed acknowledged and Recorded in the Provincial Land Records in Liber B T N.o 1 folios 70 & 71 reference being thereunto had may more fully and at large appear And Whereas the aforesaid William Worthington Junior did not in his life Time nor any Person or Persons whatsoever on his behalf pay or satisfy unto the aforesaid John Worthington on the aforesaid times in the said recited Mortgage mentioned any part or parcel of the Principal Money or Interest due on the aforerecited Mortgages nor hath the Heirs Executors or Administrators of the aforesaid William Worthington Junior paid or satisfied unto the said John Worthington his Father his certain Attorney or Assigns since the Death of the said William Worthington Junior but the same and every Part and parcel thereof continued due and unpaid to the said John Worthington whereby the same Land and Chattels became Forfeit Whereupon the said John Worthington Father as aforesaid after the Death of the said William Worthington Junior took into his Possession the aforesaid Tract of Land called Welshes Cradle mentioned in the last recited Indenture of Mortgage and also the Negroes with their Increase Stock of Cattle with their Increase and Horses and Mares with their Increase mentioned in the first recited Indenture of Mortgage and still continues in the Actual Possession of the aforesaid John Worthington Father and Grand Father as aforesaid Now this Indentured Witnesseth That the said John Worthington son of the said William Worthington Junior and Grand Son to the aforesaid John Worthington one of the Parties hereto for and in consideration of the sum of One Hundred Pounds Sterling Money and also for the further consideration of the five following Negroes to wit Old Dick Young Dick Tom Nan and Cloe all of which said last Negroes are now in the Actual Possession of him the said John Worthington Grand Son as aforesaid and paid and Delivered by the said John Worthington Grand Father as aforesaid to him in the said John Worthington Grand Son as aforesaid the receipt whereof he the said John Worthington Grand Son as aforesaid doth hereby acknowledge and thereof and of and from every part and parcel thereof doth exonerate acquit (and) |
