(17) Ex.d Maryland to wit This Indenture Made this fifth day of September in the Year of our Lord One thousand Seven hundred and fifty Nine Between Joseph Howard of Ann Arundel County in the Province of Maryland Gentleman and Joseph Hill Bailey of Fairfax County in the Colony of Virginia Planter Son and Heir at Law of Robert Bailey deceased of the one Part and Benjamin Beall of Annapolis Gentleman of the other Part Witnesseth that the said Joseph Howard and Joseph Hill Bailey for and in consideration of the Sum of Five Shillings Lawfull Money of England to them in Hand paid by the said Benjamin Beall at or before the Ensealing and Delivery of these Presents the receipt whereof is hereby acknowledge Have bargain and sold and by these Presents Do Bargain and Sell unto the said Benjamin Beall All that Tract or parcel of Land lying in Ann Arundel County on the South Side of South River and on the West Side of a Creek called Jacobs Creek the same being by Estimation One Hundred Acres it being the Moiety or one half of a Parcel of Land called Rich Neck Beginning at a marked Red Oak and running thence North West Seventy and five Perches to a Marked White Oak standing at the Head of a Valley in the line of a Parcel of Land formerly belonging to John Clark thence South West and by South forty and five Perches to a marked white Oak thence South East and by East three Hundred and twenty Perches to a marked Beach standing by a the Mouth of another cove of said creek thence North West and by West to the first mentioned Red Oak with the appurtenances To have and to hold the said Tract or Parcel of Land Tenements Hereditaments and Premisses with the appurtenances hereby bargained and sold or meant mentioned or intended to be hereby Bargained and Sold unto the Said Benjamin Beall his Executors Administrators and Assigns from the day next before the Day of the Date of these Presents for and during and unto the full End and Term of one whole Year from thence next ensuing and fully to be Compleat and Ended to the Intent and Purpose that the said Benjamin Beall may be the better enabled to receive and take a Grant or Release of the Premisses hereby Bargained and Sold or mentioned or intended to be hereby Bargained and Sold to him and his assigns for and during the Natural (Life) |
