392) Thomas which his Eastate is Engaged for besides the ^one^ hundred and sixty pounds aforesaid the Quanty of six hundred forty three pounds of tobacco Ninety ^eight^ pounds two shillings and three pence Currant mony and twenty Nine pounds three shill.s and Nine ^pence^ sterling the account mentioning the severall and particular Sumes and Quantities of tobacco goods sold and Delivered my Father Thomas Brown his order or notes on the said Amos paid &c.a which afores.d conditions or provisoes if the said Thomas Brown his heirs ex.rs and adm.rs should and Doe faithfully performe and fullfill by both the above mentioned payments of the bills of excha for the sumes & on the days and times also the same bills of excha be duly paid in London afd to the said Amos Garrett or order also besides the other aforemenconed sume and sumes of Mony Quantity of tobacco be duly satisfied and paid that then the deed and every clase clause and article and the estate thereby made to Cease Determine and be Void to all Intents & purposes Which severall conditions or provisoes hath not been by the said Thomas Browne his heirs ex.rs or adm.rs or ^by^ any other person or psons complyed ^with^ This Indenture farther wittnesseth That Thomas Browne of the one party Son and heir at Law to his Father Thomas Brown aforesaid by a Deed of Indenture made the fourth day of October last acknowledged and recorded in the provinciall Records of Maryland Lib.r T P foll 339 for the consideration therein Mentioned did thereby alienate assigne sell and make over to his Next Brother John Brown of the other party for the better to enable him to redeem the Lands &c.a that any wise ^ways^ belonged or were the Right of the said Tho.s Brown the father Deced or ^of^ him the said heir at Law Thomas Browne from some engagem.ts they Lay under as therein specified that he the said Thomas Brown being no ways able to doe the same Did therein convey and make over all his Right Title Equity and Right of Redemption of in and to Nine Severall tracts and parcells of land being of the eleven tracts or parcells of Land Conveyed over by his father to the aforementioned Amos Garrett Now This Indenture Wittnesseth that the said John Brown Second Son of his Father Thomas Brown haveing bought the Rights to his fathers ^Reall^ Estate of his elder brother Thomas to whome he is heir at Law being lately deced he the said John not being Desirous to Comply and Pay the aforementioned sumes by Bills of Exchange one thereof for eighty pounds Sterl dated the 25.th December 1714 at 20/ds Sight |
