299 by the said Benj.a Burgess by deed conveyed unto the above Named Tho.s Frisby To have and to hold the afd Land with all the appurtenances unto her the said Rachell Gree^n^berry her heirs and Assignes forever And the said Tho.s Frisby for himselfe and his heirs doth hereby covenant promise Grant & Agree to & w.th the said Rachell Greenberry her heirs and Assignes that he the said Tho.s Frisby at the ensealeing and and Delivery of these p.rsents is and untill a good and perfect Estate shall be made and executed of the said Land and P.rmises unto the said Rachell Greenberry and her heirs shall continue and be seized of all and singular the before mencond bargained premises and every part thereof of good lawfull perfect absolute sole and indefeazable Estate of Inheritance in fee simple to y.e said Rachell Greenberrys own proper use and behoof without any Condition Mortgage Limitation of use or uses or other things to alter change determine or incumber the same or any part or parcell thereof And that he the s.d Tho.s Frisby will for ever warr.t and defend the same unto her the s.d Rachell Greenberry unto her the said Rachel Greenberry her heirs & assignes ag.t all manner of persons whatsoever claiminig any interest therein or thereunto whether by the lands runing into more Elder or Antient Surveys or otherwise And Lastly he the said Tho.s Frisby and his heirs shall and will at any time hereafter make do acknowledge suffer and execute all and every such further and other reasonable act and acts thing & things as by the said Rachell Greenberry ^her heirs or assignes shall be reasonably devised advised or required Provided Always & it is y.e true intent & meaning of these p.rsents that in Case the said Thomas Frisby^ his heirs or assignes shall at or before the sixteenth day of October w.ch shall be in the year of our Lord one thousand seven hundred & fourteen pay or cause to be paid unto the said Rachel Greenberry her heirs ex.rs or adm.rs the full and just sume of one hundred fifty two p.ds fifteen shil sterl mony of Great Brittaine by good bills of exchange or otherwise according to the likeing of the said Rachell Greenberry that then this deed every clause and article therein and the estate thereby made to cease determine and be made voyd to all intents and purposes otherwise this deed be and continue in full force and effect as if the afd Provisoe had never been made In Wittness w.rof the said parties have hereunto Interchangeably set to their (hands) |
