154 West one hundred and Eighty ^pearches^ to a bounded white Oake of the said land thence south east four hundred & sixty and two perches thence with a straight line to the first bounded tree Containing two hundred Thirty one Acres or Land more or less Alsoe ^all^ that four^th^ part of a Lott of Ground and house thereon lying scituate & being in Prince Georges County af.d in a town or place Called Malbrough Town and oposite to the house of M.r Thomas Spr^i^gg wherein Elizabeth Clark now liveth and Allsoe three Negrows slaves the one Called Jeffry aged about Eighteen years the other Quabbore about Twenty Eight years and The third Phillis about six years old To have & to hold the above bargained premises & every of them with their & every of their Rights Members and Appurtenances unto him the s.d Charles his heirs & assignes forever ^to & for y.e only proper^ use ^and behoof of him y.e s.d Charles his heirs and assignes for ever and to no other use^ intent meaning purpose or Construction what soever & the ^s.d^ Thomas doth hereby for him & his heirs Convena^n^ promise grant and Agree to & with him the said Charles & his heirs that the Bargained premises are Cleare and free from all & all manner of incumbrances Whatsoever and the same & every member part & parcell Thereof against all persons whatsoever he will warrant & forever defend provided Nevertheless & it is the true intent and meaning of these presents that if the s.d ^Thomas Claget his heirs ex.rs or adm.rs shall & will well & truly pay unto the said^ Charles Carroll his Executors Administrators or assignes the Above Summ of one Hundred pounds sterl att or upon the sixteenth day of July which shall happen to be in the Year of our Lord God One Thousand seven hundred ^and^ sixteen with legall & Anuall intrest for the same untill such the s.d day of payment then this deed and every Article & Clause thereof shall be void & of no Effect Otherwise to Remain absolute & in full force In Witness whereof the s.d parties have hereunto set their hands & affixed Their seales the day and year first above Written Tho.s Clagett (Seale) seald & delivered in the presents of Thomas Smyth Will.m Fitz Redmond On the back of the s.d Deed was thus Indorst Viz.t Maryland fs July the 8.th 1713 Then Came the within Named Tho.s Clagate & Mary his Wife before Tho.s Smyth Esq.r one of her Majestyes Justices for the Provincial Courte of the s.d Province of Maryland & acknowledged the within deed according to act of Assembly in that Case made & provided & the s.d Mary being by me privately Examined gave her Consent thereunto without the least ^threats^ fears Compulsion or Coertion of her said Husband Tho.s Smythe recorded Aug.t y.e 3.d 1713 651 Att the req.t of M.r Tho.s Clegat the fol is Recorded it being endorst on the back of the aforegoing Convey.a M.r John Beale 2.d May 1717 I desire youl vacat this upon record I haveing reced full satisfaction for y.e same As Wittness my hand Cha Carroll |
