152 And from all manner of Charges and incumbrances by him or them already done Committed or suffered or ^w.ch^ with at any time hereafter shall by him or them be done Committed or suffred And further That he the s.d William Nicholls and his heirs Executors and Administrators shall and will at any time hereafter; after default of payment of all or any of the s.d sums of money or Bills of Exchange lymitted and appointed to be paid in and by the provisoe or Condition af.d or any pte thereof at the Request Cost and Charges in the Law of the s.d Samuel Groome his heirs Executors Administrators or Assignes Make doe Acknowledge Levy Execute and suffer or Cause to be made don acknowledged Levyed Executed and suffered all & every such further and other Lawfull and Reasonable Act & Acts thing and things devices Conveyances & Assureances whatsoever for the further assureing sure Making setleing and Conveying of the s.d two peeces or parcels of Land & premises with the appertenances unto and upon the s.d Samuel Groome his heirs and Assignes for ever be the same by matter ^of record^ or not of Record as by the s.d Samuel Groome his his heirs Executors or Assignes or his or their Councill Learned in the Law shall be Reasonably a^d^vised Devised or required And lastly it is Covenanted Concluded and agreed upon by and between the s.d partyes to These presents and that their true intent & meaning was and is hereby Declared to be That the near proceeds of all such Tobacco as The s.d William Nichols hath shipt and consined unto the s.d Samuel Groome and was ^which^ Came to his hands and not accounted for by the s.d Samuel Groome with the s.d William Nichols shall be discounted out of the aforesaid principall Money and That noe intrest shall be Charged but for the principall Money afd that shall be remaining due to the s.d Samuel Groome after such deduction any thing in these presents Contained in the Contrary thereof in any wise Notwithstanding In witness whereof the partyes first above named to these present Indentures interchangeably their hands and seales have sett the day and year first above Written William Nichols (seale) on the back of the aforegoing Deed was Thus Indorst Viz.t seald and deliverd in the presents of us Memorandum that the Day and year John Leach within written Came before us ^John Leach & James Heigh two of her maj.tys Justices^ of James Heighe Calv.t County the within named W.m Richard Dallam Nichols & acknowledged the within Written Indenture to be his act and deed according to Law and at the same time Came Mary Nichols wife of the within Named William Nichols who being secretly Examind out of the hearing of the s.d William Nichols her Husband Did freely (Declear) |
