x.d This Indenture made the 25.th day of September in the yeare of our Lord God one thousand seven hundred and tenn Between Gilbert Scott of Calvert County Gentl of the one part and and John Hyde of the Citty of London Merchant of the other part Wittnesseth that the said Gilbert Scott for and in Consideracon of the sume of four hundred and fifty pounds ster to him in hand paid the receipt whereof he the said Gilbert Doth hereby acknowledge and of every part & pcell thereof doth fully Clearly and absolutely Exonerate acquitt and Discharge the said John Hyde his heires and assignes for ever by these presents as also for Divers other good Causes and Valluable Considerations him thereunto ^especially^ moveing he the said Gilbert hath Granted bargained sold aliened enfeoffed and confirmed and by these presents doth for him and his heires grant bargaine sell all in enfeoffe and confirme unto him the said John Hyde his heires and assignes for ever all those two seall Tracts of Land and negroes herein after subscribed Viz.t all that tract or pcell of Land scituate Lying and being in Baltemore County adjoyning on [illegible] River called Dunkwell and Cont.a five hundred acres and also all that tract or parcell of Land scituate Lying and being in Calvert County on the Clifts called Upper Bennett & Cont.a two hundred acres Togeather w.th all houses edifices buildings barnes stables orchards Gardens ways waters woods underwoods proffitts comodities Improvements appurtenances whatsoever to the s.d two tracts of Land belonging or in any wise appertaining and the reversion and reversions remainder & remainders of all and singular the said Lands and premises or any part thereof as also five negro men named and aged as followes (Viz.t) Dick aged thirty yeares hazard aged Twenty yeares Hanniball aged thirty yeares Dundee aged thirty yeares and Jack aged fourteen yeares and Lastly a negro woman named Mary aged thirty yeares togeather with thirty head of Large Black Cattle On the said tracts of Land and thirty Ewes & two ramms all on the said plantacon Called Upper Bennett To have and to hold the said Tracts of Land and premises afd w.th the apputts above granted and every part and pcell thereof unto the said John Hyde his heires and assignes for ever to and for y.e only proper use and behoofe of him the said John Hyde and his heires and to no other intent meaning construction or purpose whatsoever and the said negroes cattle and sheep unto him the said John Hyde his ex.rs adm.rs or assignes and the said Gilbert Scott for himselfe his heires ex.rs and adm.rs doth hereby covenant pmise Grant & agree to and w.th the said John Hyde and his heires that all and every of the above menconed premises are at the time of the ensealing and delivery of these presents clear and free of and from all and all manner of Incumbrances whatsoever whether by statutes judgments recognizances forfeitures or attainders of him the said Gilbert Scott or the Lines of the said Tracts or either of them running into more ancient surveys or by any other ways or means whatsoever save only the Quitt Rents now due or hereafter to grow due to the R.tt Hon.ble the Lord Proprietary (and) |
