104 out of the same To have and to hold the said severall tracts peices or Parcells of Land and all and singular the Premises herein before mentioned and Intended to be hereby granted bargained and sold released and Confirmed and Every Part and Pcell thereof with their and every of their appurtenances unto the said John Hyde his heires and assignes for ever to the only pper use and behoofe of the said John Hyde his heires and assignes for ever Provided nevertheless and these presents are upon this Condition that if the said Richard Smith his heires ex.rs adm.rs or assignes or any of them do and shall well and truly pay or Cause to be paid unto the said John Hyde his ex.rs adm.rs or assignes the full and just sum of Five hundred and fifteen pounds of Lawfull money of Great Brittain upon the ninth day of July now next Comeing without any deduction defalcation or abatement whatsoever for or in respect of any taxes charges or assessment taxes charged or assessed or to be taxed charged or assessed upon the said premises or any part thereof or upon the said sum of five hundred and fifteen pounds or any part thereof by any act of Parliament now in being or hereafter to be made or otherwise howsoever that then and thereupon the said John Hyde his heires or assignes shall and will at the costs and charges of the said Richard Smith his heires ex.rs and adm.rs Reconvey the said tracts peices or pcells of Land and premises and all the estate right title and interest claim and demand w.tsoever of the said John Hyde his heires & assignes of in & to the same unto the said Richard Smith his heires or assignes or to such other pson or persons as he or they shall direct or appoint freed and discharged from all incumbrances w.tsoever done by the said John Hyde his Heires and Assignes And the said Ric.d Smith for himself his heires ex.rs and adm.rs doth covenant promise and agree to and with the said John Hyde his ex.rs adm.rs and assignes and to & w.th every of them by these presents that he the said Rich.d Smith his heires ex.rs or adm.rs or some of them shall and will well and truly pay or cause to be paid unto the s.d John Hyde his ex.rs adm.rs or in y.e original assignes or some of the said sume of five hundred and fifteen pounds of Lawfull money of Great Brittain upon the day & time as is before agreed for the payment thereof Clear of all (Charges) |
