838 and Assigns Provided always & it is the true intent & meaning of these presents that If the sd Tho Stirling his heires Exc.rs or adm.rs or either of them shall & will att or before the sayling out of this province of the next fleet to arrive out of England pay or Cause to be paid unto the s.d John Hyde or his Attorney att the port of Annapolis the sume of one hundred & eleven pounds eight shillings & two pence by good bills of Exchange w.ch shall be Duly Accepted, & p.d & Drawn on som responsible Merchant in London w.th legall interest for the same till such time as the sd fleet shall saile, as also by the next Ensuing fleet after the like sume of one hundred & eleven pound eight shill & two pence ster w.th interest as afd & the remaining one hundred & Eleven pounds eight shill & two pence ster by the third fleet or returne of shipps hence to England w.th legall interest as afd till the time of such returne that then this Deed shall bevoid & the Estate thereby made to the sd John Hyde shall Cease, & Determine, but in Case of failure of paym.t of the sd interest and principall afd then the Estate thereby made to remain absolute Indefeizable & Valid to all intents & purposes unto him the sd John Hyde his heires & Assigns for ever In Wittness whereof the partys to these p.rsents have hereunto interchangably sett their hands & seales the day and year first above written Thomas Sterling (Seal) |
