Quere Whether the heir at Law of the said Willm the father for he
has sons by a former Venter or the heires at Law of Willm the son for he
had brothers by the same Venter shall inheritt the said Land

It is most plain that the Inheritance of the plantation vested
in W.m Burgess the son by the will of the father as by purchase &
from him will Descend to his next Brother of the whole  And it is not
Materiall that he dyed in the life of his mother he taking by purchase
& not by Descent therefore there is noe p.rtence for the brother of the half
blood who is heir to the father to claime this plantation since whoever
is Intituled must be son as heir to W.m the son which none but
of how he be blood can be
