       the secretary Recorded as follows Viz.t

                   By his Excellency y.e Gov.r & Councill

                         Sept.r 23.d 1706

       In regard there is no provision made y.e secretary
       for the foll.o services ordrd y.t he take for
       Every oath taken in open court Eight
       pounds of Tob.o for every Execution &
       Returne allowed twenty eight pounds
       of tobacco for pbatt of accounts in open
       Court Eight pounds of tob.o for every
       matter not Exceeding half a side the
       law having given no fee therefore
       allowed to take untill y.e next assembly
       Eight pounds of tob.o
