95 Proctor would not give it And this Deponent further Sayth that his Said master wrote a Certaine Contract or Bill of Sale for this woman Servant but that M.r Proctor Excepted ag.t the Same whereupon M.r Proctors Bookkeeper Drew another Bill of Sale w.ch this Deponent heard read but that he knoweth not whether it was Signed or Sealed After w.ch 2 Bottles of wine Came in but upon what accompt they were Brought in he knoweth not And this Depon.t Saith he heard M.r Bland Say that he had sold the said Servant to M.r Proctor And this Deponent farther Sayth not Henry Mathew aged about 26 yeares Saith that M.r Bland brought the woman Servant above menconed to M.r Proctors on a Saturday night and sold to M.r Proctor for 2 Bottles of wine and that he this Deponent said I saw a Bill of Sale (signed and Sealed for the said Servant M.r Proctors Bookekeeper being a Witnesse to the same And this Deponent sayth that the said Servant was Left att M.r Proctors as his Servant by the Said Bill of Sale and further Sayth not Whereas Thomas Bland one of the Attorneyes of this Court according to the Customes and priviledgs of the Same was Sumoned to answer to Robert Proctor of a plea of Trespass upon the Case and the said Robert Proctor Declared ag.t the said Thomas for breach of his promise and Assumption to Sattisfy and pay a hog.d Tobacco to the said Robert in Consideracon of necessary accomodacons for one whole moneth had and receive By Allice Spyer the Suposed prop Servant of the said Thomas Bland att the house of the sayd Robert and att the Instant Request of the said Thomas And the said Thomas Bland did plead that the Said Allice Spyer was att the tyme in the declaracon menconed by him Left at the house of the said Robert as the proper Servant of the said Robert By Bill of Sale And the Said Robert Proctor did thereupon Reply and averre that the said woman Servant was att the tyme aforesaid Left att his house as proper Servant of the said Thomas and not of him the said Robert The said Thomas Bland makeing noe sufficient proofe to this Court of his plea aforesaid and it appeareing to this Court that the woman Servant above menconed was accomodated for a whole month at the house of the said Proctor It is Considered here that the said Thomas Bland shall forth satisfy and pay the Sume or quantity four hundred pounds of Tobacco and Caske to the said Robert Proctor or his order togeather with Costs of Suite and Court Charges att Execution And thereupon the said Thomas Bland prayed an Apealle from the Judgement aforesd and that the said Cause might Come before his Lordsps Justices att his provinciall Court to be held att his Citty of S.t Maryes on the 8.th day of October next ensueing and that the Tenour of the Record and proceedings in the Cause above might be sent to his Lordsps Justices of his provinciall Court aforesaid And thereupon the said Appellant togeather with Nicholas Shepherd his Suretie allowed of By this Court became bound to the said Robert in the full Some of quantyty of one thousand Six hundred pounds of tobacco and Caske to be Leavyed on these goods or Chattles Lands or Tenements to his Judgement aforesaid and in Case Likewise that the Said Thomas Shall not Satisfye and pay (if the said Judgem.t be Affirmed) all and singular the Debts damages and Costs adjudged or to be adjudged upon the Said Judgement aforesaid and all Costs and Damages also to be awarded for delayinge of Execucon upon the Said Judgement unlesse the aforesaid Thomas doe pay the Same or Render his body to prison True Coppy Examined by me Ri Boughton Clke Which Being Read and heard and the said Thomas Bland in his prop person and George Parker Attorney for the Said Rob.t Proctor being present and hereupon the premisses being Serve and by the Justices here fully understood and diligently Examined it sheweth to the said Justices here that noe false Judgement is made in the said plaint in the aforesaid County of Ann Arundell County neither is there any Error in the said Record but that the Judgement given in the Said plaint is good and sufficient in Law and that noe Error is therein therefore it is Considered this day to witt the 12.th day of March in the 4.th yeare of the Dominion of Charles &.ca Anoq Dom 1678 that that Judgement be affirmed and that in all things it stand and Remaine in force be your Strength and virtue notwithstanding the allegation and assignement of Errors of the said Thomas Bland all further by y.e same Court it is Considered that the s.d Robert Proctor Recov ag.t the said Tho Bland the sume of Eight hundred & six pds of Tobacco to him y.e s.d Robert Proctor by the Court here adjudged for his Costs and Charges by him in this behalfe sustayned and that the s.d Rob.t Proctor have thereof Execucon &.ca |
