96 William Dorrington Late of the County of Dorchester in the province of Maryland Maryland fs Planter was Attached to Answer unto Walter Dunch of a plea of Trespass on the Case &.ca And whereupon the said Walter Dunch by George Parker his Attorney Complayneth that whereas the said William Dorrington the Fourteenth day of february one thousand six hundred Seaventy eight Stood Indebted unto the said Walter Dunch in the full sume of one hundred and twenty pounds sterling money of England Being the Remaynder of three hundred pounds sterling money Contracted between the said W.m Dorrington and the said Walter Dunch as the portion of Mary Johnson Alis Dunch Late wife of the said Walter Dunch and Daughter of Anne Johnson the Late wife of the Said W.m Dorrington In Consideracon whereof the said W.m Dorrington did assume upon himselfe and to the said Walter Dunch did Faythfully promise when thereunto Required the said sume of one hundred and twenty pounds Sterling money would well and Truely Content satisfye and pay Notwithstanding the said W.m Dorrington his promise and assumption Little Regardinge but meaning and fraudulently Intending him the said Walter Dunch in this behalfe Craftily and Subtilly to deceive and defraud the said sume of one hundred and twenty pounds Sterling money Although often thereunto Required unto him the said Walter Dunch hath not payd nor satisfyed according to his promise and assumption aforesaid but the same to pay hath denyed and as as yet Doth deny to the greate damage of the said Walter Dunch whereupon he Saith he is Dampnified and hath Losse to the value of two hundred pounds Sterling money of England and thereupon he bringeth his Suite John Doe pledges de ps Richd Roe Geo Parker p quer And the said Will Dorrington By Robert Ridgley his Attorney Cometh and defendeth the force and Injury with &.c and Saith that as to the said sume of one hundred and twenty pounds Sterling money in the declaracon menconed he hath nothing to say in Barr of the action of his said Walter but that he should recover the same ag.t him whereupon the said Walter Remayneth ag.t the Said W.m as to the said sume of one hundred Twenty pounds Sterling money undefended therefore it is Cosidered of by the Court here this day to witt the seaventh day of March in the fourth yeare of the Dominion of Charles &.ca anoq Dom 1678 that the said Walter Dunch doe Recover ag.t the said W.m Dorrington the said Debt of one hundred and twenty pounds Sterling money to ^560 Tobacco^ Costs of suite and the said W.m in mercy &.c Robert Ridgely p Def.t Maryland fs To M.r Robert Ridgely one of the Attorneys of his Lordsps provinciall Court for the province of Maryland I pray appeare for me William Dorrington of the County of Dorchester in the province of Maryland and receive a declaracon att the suite of Walter Dunch Comander of the good ship Charles and Confesse Judgement thereupon for one hundred and twenty pounds Sterling money of England Soe that Judgement may forthwith passe ag.t me for the same sume and for your soe doeing this shall be your sufficient warrant given under my hand and Seale dated the Fifteenth day of February annoq Dom 1678 W.m Dorrington Sealed Signed Sealed and delivered in the presence of Thomas Tayller Geo Parker Memorandum that on the 4.th day of March in the 4.th yeare of the Dominion of Charles Lord Baltemore &.ca anoq Dom 1678 Thomas Truman Richard Ladd and Charles Boteler gentl p.rsented unto the Court these papers following |
