93 Memorandum that on the Sixth day of March in the 4.th yeare of the Dominion of Charles Lord Baltemore &.ca Anoq Dom 1678 Phillip Calvert Esq.r one of the Justices of this Court p.rsented unto the Court with his own proper hands the foregoeing paper Att a Court of the Right hono.ble Charles &.ca held att the Ridge in Ann Arundell County on the tenth day of September in the third yeare of the Dominion of his Lordsp over Maryland &.c Anoq Dom 1678 by his Lordps Justices thereunto Assigned L.tt Coll Thomas Tayllor Henry Stockett present Com.rs Robert Frankline D.r Henry Lewis gein Nath Heathcote Thomas Francis Robert Proctor plt Tho Bland Deft It was Comanded the Sheriffe of Ann Arundell County that he Sumons Thomas Bland one of the Attorneys of this Court according to the previlidges of the same to be and appeare before the Justices of his Lordsps Court in the said County to be holden on the 13.th day of August last past to answer to Robert Proctor of a plea of tresspass upon the Case Att which day (to witt) the 13.th day of August aforesaid Came the said Sheriffe and retorves to the Court here that he hath Sumoned the said Tho Bland to be and appeare before his Lordsps Justices &.c as the writt required Ordered that the said Cause be Continued till the tenth day of September Instant And the Same day (to witt) the tenth day of Sep.r aforesaid Came the aforesaid Thomas ^Rob.t^ Proctor by Henry Hanslapp his Attorney and offered himselfe ag.t the said Thomas of and upon the premisses and the Said Thomas Came Likewise in his proper pson whereupon the Cr.ts Declaracon was read as followeth (viz.t) Ann Arundell County Court fs Thomas Bland One of the Attorneyes of this Court was according to the Privildges of the Same Sumoned to answer unto Robert Proctor of a Plea of Trespass on the Case And whereupon the Said Robert Proctor by Henry Hanslapp his Attorney Complaineth that whereas the said Thomas Bland upon the 27.th day of Aprill Annoq Dom 1678 unto the house of the Said Robert in the County of Anne Arundell aforesaid the Said Robert being an ^Lycensed^ Inholder Did bring one of his women Servants named Allice Spyer the said Allice being then diseased sicke and in a weake Condicon the Said Thomas Did then and there make Just request unto the Said Robert that he the Said Robert would Receive and take the Said Allice into his house for one whole month thence ensueing and Lett her the said Allice have meal drinke washing Lodging Attendance and all other necessary accomodacons Conseived During the Said tyme In Consideracon whereof the said Thomas did Assume upon himselfe and unto the Said Robert faythfully did promise one hog.d of good marchantable Tobacco well and truely to Content Satisfye and pay which Said Hog.d of Tobacco the Said Robert did then Compute according to the usuall Custome of the Country to Conteyne 400.ℓ neatt Tobacco now the Said Robert in fact sayth that trustinge to the truth and faythfullnesse of the assumption and promise of the Said Thomas the said Allice he the said Robert did receive and take into his house and meate drinke washing Lodgeinge Attendance and all other necessarye accomodacons Convenient during the Tyme of one whole month and three dayes the Said Allice had received to y.e greatt Expence Charge and Trouble of the said Robert Notwithstanding the Said Thomas his assumption and promise little reguarding But fraudulently Intendinge him the Said Robert in that Behalfe to deceive of the Said hogg.d or 400.ℓ of neat Tobacco y.e Said hog.d of Tobacco unto the said Robert hath not in any wise Satisfyed Contented and payd But the Same to pay doth deny and refuse (although often thereunto required) whereupon the said Robert Sayth he is the worse and hath damage to the Value of Eight hundred pounds of Tobacco and thereupon Bringeth his Suite pledges psen Jn.o Doe Richd Roe Henry Hanslap pro quer |
