By Thomas Gilbert I Allow two thousand nine hundred Forty six pounds of this account and noe more Philip Calvert which being read and heard it is ordered by the Court here this day to witt the 10.th day of october in the third yeare of the dominion of Charles Lord Baltemore &.ca Annoq dom 1678 that a scire facias Issin to the Sherriffe of Dorchest.r County to make knowne to the said John Brooke that he be and appeare att the next provinciall Court to shew Cause why exemcon Should not Issue ag.t the Estate of the said W.m Morgan for the aforesaid sume 2946 ₤ of Tobacco soe allowed as aforesaid Maryland fs Garratt Vansweringen Late of S.t Maryes Citty gentl otherwise Called Garratt Vansweringen of S.tt Maryes Citty inholder was Summoned to answer unto George Markes of the Citty of Bristoll Marriner of a plea that he render unto him the Sume of Eight thousand five hundred poundes of Tobbacco with Casque to Conteyne the Same w.ch to him he oweth and unjustly deteyneth And whereupon the said George Markes by Robert Ridgely his Attorney sayth that whereas the Said Garat Vansweringen the Last day of May in y.e yeare of our Lord 1678 att S.tt Maryes Citty aforesaid Did borrow of him the Said George Markes the Said Sume of Eight thousand five hundred pounds of Tobacco to be payd to the Said George when thereunto Required notw.thstanding which the said Garrat the Said Eight thousand five hundred pounds of Tobacco to him the said George though often thereunto required hath not paid but the same to pay hath denyed and as yet doth deny to the damage of the said George Tenn Thousand pounds of Tobacco And thereupon he produceth his Suite John Doe pledg diq Richd Roe Ridgely p Quer Memorandum that thsi day 25.th day of February in the yeare of our Lord 1678 before me Phillip Calvert Esq Chancell.r of this province and one of the Justices of the Provinciall Court at my house at S.tt Peters at the said Citty of S.tt Marys personally appeared Garrat Vansweringen above named in his proper person and did Consent that Judgment should passe ag.t him for the said Sume of Eight thousand five hundred pounds of Tobacco att the Suite of the Said George Markes in maner and forme as the said George Markes above ag.t him hath declared Provided that Execucon upon the Same Judgement Cease untill the tenth day of November now next Comeing Philip Calvert |
