9 1676 On the Backside of the foregoing Indenture was written (viz) Memorandum that this day to wit the Second day of March Anno 1676 Came before us Phillip Calvert Esq.r & William Calvert Esq.r Justices of the provinciall Court of the Province of Maryland the within named George Fidler who hath Signed Sealed & delivered the within Specified or written Indenture according to the true intent & meaning therein Specified & did acknowledge the same to be his Acte & deed in the p.rsence of us Philip Calvert Will Calvert This Indenture made the first day of November in the yeare of our Lord God one thousand Six hundred sixty & Seaven Betweene William Calvert of Calverts Rest within the County of S.t Maryes and Province of Maryland Esq.r and the Lady Elizabeth his wife of the one part & William Asbeston of the aforesaid County planter of the other part Witnesseth That the Said Calvert & Elizabeth his wife for divers good causes & valuable Consideracon that thereunto Especially moveing hath demised granted & to farme letten & by these p.rsents for ever Sould unto William Asbeston aforesaid his heires Exec.rs Adm.rs & Assignes all and Singular that Messuage or tenement of him the Said Calvert Scituate Lyeing & being in S.t Michaels Mannors in the aforesaid County Comonly called & knowne by the name of Deepe Creek beginning at A Spannish Oake upon Chsipiake Bay running to the deepe Creeke dew North & from the aforesaid line running dew West unto A Gum from thence unto A white Oake North northwest upon the maine Branch of Deepe Creeke from thence running downe ^the maine Branch^ dew East unto A marked Pokickry Conteining and now laid out for one hundred Acres of land ^be it more or lesse^ with the appurtenances & houses Edefices buildings orchards Gardens with all other the Said William Asbeston his heires Exec.rs Adm.rs & Assignes all & Singular the premisses aforesaid without any manner of Suite trouble Eviction contradiction disturbance or molestation whatsoever of or by the aforesaid Calvert or the Lady Elizabeth his wife or theire heires Exec.rs Adm.rs or Assignes or any other pson or psons haveing or pretending to have any manner of Claim right title or Interest in the aforesaid pcell of Land or any part or pcell thereof for ever yeilding & thereout payeing yearly unto the Said Calvert or the Lady Elizabeth his wife or theire heires Exec.rs Adm.rs or Assignes four Capons at or by the tenth of October at the Mansion house of the Said Calvert in Calverts Rest & one Barrell of Indian Corne for Iloriott and in case the Said Rent be behind & unpaid within ten dayes before or after the Said time of payment that then it Shall & may be lawfull to & for y.e Said Calvert or Elizabeth both his wife theire heires Exec.rs Adm.rs & Assignes to destreine upon the premisses and for want of Sufficient distresse to reenter & the Same to hold & enjoy as his or theire former Estate & the Said William Calvert & the lady Elizabeth his wife doth by these p.rsents bind themselves theire heires Exec.rs Adm.rs & Assignes to warrant & defend the premisses unto the Said Asbeston his heires Exec.rs Adm.rs & Assignes from all just Claimes whatsoever as abovesaid In Witnes whereof the Said William Calvert and the Lady Elizabeth his wife have to these Indentures interchangeably Set theire hands & Seales the day & yeare above written Sealed Signed & delivered in the p.rsence Will Calvert sealed of us Elizabeth Calvert sealed The M marke of Daniell Denine The marke M K of Martine Kerke Underneath the Above deed was written (viz.t) The twentieth of December 1671 Acknowledged in open Court by the Above named William Calvert Esq.r to be his Act & deed the day & yeare above Said Robert Ridgley Cler Cur Provinc On the Backside of the Above Deed was written (viz.t) Memorandum That this day to wit the Sixth day of December 1676 the within named Elizabeth Calvert did acknowledge to Consent to the Sale of the land as within mentioned to him the said William Asbeston his heires or Assignes as in the Same is Expressed before us Baker Brooke Henry Coursey |
