87 Ratifyinge & Confirming & allowinge all & whatsoever my said attorneys shall lawfully doe or cause to be done in and about the Execution of the premises by Vertue of these p.rsents In wittnes whereof I have hereunto sett my hand & seale this Eighteenth day of Aprill in the Third yeare of the Dominion of Charles Lord Baltemore &c Annoq Domi One Thousand six hundred seaventy Eight Sealed & delivered Rob Williams sealed in y.e p.rsents of us John Mitchell Robert Glasgon John Fox Underneath the aforegoinge Letter of attorney (was written viz.t) Memorandum that this day to witt the One & Twentieth day of December in the Fourth yeare of the Dom of the R.tt Hon.ble Charles Lord Baltemore &c annoq Domini One thousand six hundred seaventy Eight before me W.m Calvert Esq.r One of his Lopps Justices of the Provinciall Court came John Mitchell one of the Wittnesses to the above Letter of attorney and made oath upon the Holy Evangelists that he saw the Constituant Robert Williams signe seale and deliver the same as his act and Deed to the uses therein menconed and that he subscribed his name as a wittnes thereunto Sworne before me Will Calvert This Indenture made the Nine & Twentyeth day of January in the fourth yeare of the Dominion of the Right Hon.ble Charles Absolute Lord and Prop.ry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c Annoq Domini One thousand six hundred Seaventy and Eight Betweene Capt Justinian Gerrard of the County of Saint Maryes of the one part and Thomas Notley of the same County of the other part wittnesseth that the said Justinian Gerrard for and in Consideration of the sume of Tenn Thousand pounds of tobacco to him by the said Thomas Notley already in hand paid before the Ensealeing and delivery of these presents the Receipt whereof he the said Justinian Gerrard doth hereby acknowledge and thereof and of every part and parcell thereof doth hereby fully acquitt Exonerate and discharge him the said Thomas Notley his heyres Executo.rs and Adminstrato.rs for ever Hath aliened bargained sold and Enffeofed unto him the said Thomas Notley All that Tract or parcell of Land called the Neighbourhood lyeing scituate and being in S.t Clements Manno.r in the County of Saint Maryes aforesaid butting and bounding as foll.d (Viz.t) Begining att a Little bridge over a small River divideing betweene the said Notleys Land called Manahowicks Neck and the said Justinian Gerrards Land Called Bramley from thence runing south East sixty Perches unto a marked Pokehyckery with Nine Notches standing neere a Little Runn att the head of Bramley Creeke from thence runing North East sixty Perches by line trees One hundred perches to a marked Beech with Nine Notches standing on the side of a deep Runn from thence runing East by line trees Ninety two Perches to a white oake marked with Nine Notches from thence runing East North East Twenty Eight perches to a bounded white oake with Nine Notches from thence runing North west downe a deep Swamp or Runn One hundred and forty Perches to a marked Gumm with Nine Notches standing in the said Swamp or Runn being the Then bound Tree of the aforesaid Tract of Land called Manakowickes Neck belonging to him the said Thomas Notley from thence runing Southwest One hundred Ninety Two Perches to the said Bridge the first boundary together with all houses buildings and Edifices thereupon Erected and all and singular the appurtenances thereunto belonging together with all the waste Land lyeing betweene the south East Line drawne from the said Bridge to the first marked Pokehyckory and the head of Bramley Creeke Containing One hundred Acres more or lesse To have and to hold the said Tract or Parcell of Land freely fully and absolutely acquitted Exonerated and Discharged from all and all manner of sales grants Deeds Leases Debts Judgments Executions Extents or other Incumbrances whatsoever had made done or acted by him the said Justinian Gerard or by any other person or psons whatsoever by his consent privity or knowledge permission or procurem.t (unto him the said Thomas Notley his heyres and assignes for Ever Yeilding and paying therefore yearly and every yeare unto him the said Justinian Gerrard his heyres Ex.rs or Admin.rs Tenn Dayes before or after the Nativity of our Blessed Savio.r the Annuall Rent foure shillings sterl of the same be legally Demanded And further the said Justinian Gerrard doth for himselfe his heyres Executo.rs and Adm.rs covenant promise and grant to and with the said Thomas Notley his heyres Executo.rs & Adm.rs the said Tract or parcell of Land with all and singular its appurtenances unto him the said Thomas Notley his heyres and assignes from him the said Justinian Gerrard his heyres & Assignes and from all other persons whatsoever for ever to warrant and Defend by these p.rsents In wittnes whereof the partys to these p.rsents have Interchangeably sett their hands and seales the Day & yeare above written Sealed & delivered in p.rsence of Justinian Gerard sealed Thomas Taillor Nathaniell Hathcote W.m Chandler John Lewellin |
