847 (826) Maryland fs Noverint Universi p p.ractes nos Edwardum Batson Richardum Marsham & Ninian Beale Genorosos Teneri et firmiter Obligari Hon.bus Commissionaribus Cusomari in augla pro Tempore p.rsenti in p.rsena et justa suma duar Mitle librarum Bona et legalis meneta angliæ solvend ejusdem Comisson.bus ant suis Certis Attornat vel Assignat suis ad quam quidan solutionem bene et fideliter faciend obligamus nos et quem libett Nostrum prose pro Toto et in solido hered Executores et Adm.ros Nostros firmiter per p.rsentes sigillijs Nostris sigillat Dat apud Po.rt Annapolis 30 die Niensis Junÿ Anno Regni Supradict Domini Nre Guili Testÿ Dei Gratia Angliæ scotiæ franc ciæ et Hiberniæ Regis &c deamo Annoq Domini 1698 The Condition of this Obligation is such that whereas the above bounden Edward Batson is by his Ex.cy Francis Nicholson Esq.r Capt Gen.ll and Gov.r in Cheife in and Over his Maj.tyes Province of Maryland and the Territoryes theretoe belonging appoynted and Commissionated to be Navall Officer of the Port of Annapolis according to the directions of a Certaine Act of Parliament Intituled an Act for the Encouragement of Trade & made in the fifteenth year of the Reigne of our late Sovreigne Lord King Charles the Second of Blessed Memory Now it soe be the said Edward Batson shall well and faithfully pforme his Duty in the said Office in all things thereto relateing then this Obligation to be voyd and of none Effect or else the same to be and Remaine in full force and virtue Sealed and Deliverd in y.e p.rsence of Edward Batson (seal) Hen Jowles Richard Hill Rich Marsham (seal) Thomas Tench Record at Aug.t 6.th 1698 p Chr Gregory Clk Maryland Know all men by these p.rsents that Wee Edward Batson Richard Marsham and Ninian Beale of the Province of Maryland afd Gent are holden and firmly bound unto his Ex.cy Francis Nicholson Esq.r his Majtyes Capt Gen.ll and cheife Gov.r of this Province in the full and just sum of one thousand pounds of Lawfull Money of England to be paid to the said Francis Nicholson Esq.r his Ex.rs and Adm.rs or Assigns to the which payment well and truly to be made wee bind ourselfs and either of us by himself our and either of our heires Ex.rs and Adm.rs joyntly and sevrally for the whole and in the whole firmly by these p.rsents Wittness our hands and seales this 3.d day of June 1698 The Condition of the above written Obligation is such that whreas his Ex.cy Francis Nicholson Esq.r afd hath Commissionated and appoynted the said Edward Batson to be Navall Officer of the Port of Annapolis within the said Province by his Commission bearing Equall date with these p.rsents Now if the said Edward Batson shall well and truly pforme the said Office according to the severall Acts of Parliament in that Case made and Provided and shall observe the directions contained in the Acts of Assembly of this Province relating to the Duty of Navall Officers and from time to time Save Defend and keep harmless the said Francis Nicholson Esq.r from all Damage Loss and Charges that the said Francis Nicholson shall sustaine at any time by reason of the said Batsons Non pformance of his said office soe long as he shall injoy the same as in the said severall Laws Enacted and ordained then the above Obligation to be voyd and of None Effect otherwise to be and remaine in full force and virtue Sealed and Deliverd in the p.rsence of Ed Batson (seale) Hen Jowles Ric Marsham (seale) Thomas Tench Ninian Beale (seale) Richard Hill Recorded Aug.t 29.th 1698 p Chr Gregory Clk |
