(72) Whereas John Cock surety for Joseph Chew late Deputy survey.r for Cæcill County hath informed the Hono.ble Governo.r and Councell of this province that the said Chew hath surveyed and layd out for divers Inhabbitants of Cæcill County seaverall tracts of land promised to make good rights for the same according to Condicons of plantacon & received Satisfacon both for the rights and survey.rs Fees that the Said Joseph Chew is runn away and as supposed will not retourne againe into this province That the said Joseph Chew hath made noe retourne into the secretary & officer of y.e Certificates of such surveys by meanes whereof seaverall persons are like to be ruined in theire estates and many Law Suites to arrise And for the p.rvencon thereof on the behalf of him self and other Inhabbitants of Cæcill County hath humbly requested that these persons for whome and in whose name the said Chew have surveyed any Lands and made noe retourne of the Certificates of survey and Rights Legally made good upon Record and warrants Issued upon the Same may have six Months time granted them for retourning Certifficates for the said Land And that for the prevention of Law suites all such surveys as are made by the said Chew without warr.t may bee vacated And the Same land bee taken up by any other pson upon any ordinary warrant Upon Reading of w.ch peticon it is this day to witt the 11.th day of June in the third yeare of the Dominion of Charles Lord Baltemore &c Annoq Dom 1678 ordered that all psons whatsoever that have had any Land bona fide surveyed & layd out for from by the said Joseph Chew upon any p.rtences whatsoever bee and are hereby allowed six months time for makeing good Rights for such Land and for retourning Certificates of survey for them into the sec.rys office And that noe pson whatsoever may take up any such Land w.ch hath been formerly surveyed by the said Joseph Chew upon any ordinary warr.t July y.e 2.th 1678 The oath of M.r Randalph Revill Senio.r laden before us Bartholomew Ennalls Charles Hutchins & Henry Bradlie Did declare that the marked white oake upon the poynt of Land called Asconoacon was marked by his own hand with sixteene notches & was the first bounder of the Hon.ble Phillip Calvert Chancellour of the Province of Marylands Mannor surveyed by Stephen Horsie about fifteene yeares Since to his the said Revells best remembrance upon the River that was then called Chicbanocomoco & then runing up Eastward upon the said River on the Easward side of a beaver damm above the Forde upon a poynt att the mouth of the said Beaver damm marked a red oake for the bounds of the Eastermost lyne the persons present at the said Revells deposition were Anthony Dawson Randalph Revill John Hodgson Bartholomew Ennalls William Reede Charles Hutchins Reece Vaughan Henry Bradly Humphrey Mould Thomas Daniel Thomas Harpin September y.e 25.th 1677 I doe hereby appoint you Robert Carvile to be my Attorney for mee in the Provinciall Court & to prosecute all suites by me prosecuted & to appeare for mee in all accons I am sued in without any further warrant of Attorney & to doe therein as to him shall seeme meete & for soe doeing this shall bee your warrant from They friend To Robt Carvile one of the John Edmondson Attorneys of the Prov.ll Court This warrant of Attorney to Continue one whole yeare & I am to pay the usuall Fees June y.e 5.th 1678 Recd then of Robert Carvile one of the Ex.rs of Richard Moy deceased the sume of Eight thousand fifty & Two pounds of Tobacco upon the accompt & for the use of M.rs Mary Ward Extrix of Mathew Ward decd for & in full discharge of one Judgement obteyned against Daniel Jenifer & Richd Moy for thirty three pounds Eleaven shillings sterling att one penny p pound in Tobacco as also seaven hundred seaventy & two pounds of Tobacco for Costs of suite & I doe hereby oblidge my selfe to procure an assignment of the said Judgement to bee made by the said Mary Ward to the said Robert Carvile as wittnes my hand & seale this fifth day of June one thousand six seaventy Eight Mary Tilghman Testes Robert Smith Josias Sikrey |
