708 (698) This Indenture made the Thirteenth day of November in the year of our Lord One Thousand six hundred and ninety and four Betweene James Jones of Northumberland County in the Colony of Virginia and Rebecca his wife of the one pte and Cap.t Thomas Wahop of S.t Maryes County Gent of the other pte Witnesseth that the said James Jones and Rebecca his wife for and in Consideracon of the sum of Five shillings Currant money of England to them in hand payd the receipt whereof from the said Cap.t Thomas Wahop the said James Jones and Rebecca doe hereby acknowledg and for severall other good Causes and Consideracons them thereunto more especially moving Have Given Granted Bargained Sold Aliened Enfeoffed and Confirmed as they doe by these p.rsents Give Grant Bargain Sell Alien Enfeoff and Confirm unto the said Cap.t Thomas Wahop All that Tract or parcell of Land called Peny Point lying and being on the Eastern shoar in a River there called Pocomoak on the south side of the said River begining at a marked pine standing south south west and runing along the said River by a line drawne North North East Two hundred and forty perches for breadth to a marked Oake and bounding from the said Oake by a line drawn south south East five hundred thirty four perches for length to a marked Oake thence runing by a line North North West Two hundred and forty perches for breadth to a marked pine and drawing a line South South West from the said pine to the first marked pine five hundred Thirty four perches containing and laid out for eight hundred acres more or less which said Tract of or parcell of land was granted unto John Wahop of S.t Maryes County by the right hon.ble Cecilius Lord Baron of Baltemore and Proprietary of this province of noble memory deceased by his letters pattents under the great seale bearing date the Twenty third day of September in the year of our Lord One Thousand six hundred sixty and five and afterwards devised by the said John Wahop in and by his last Will and Testament unto the said Rebecca Jones daughter to the said John To have and to hold the said Tract or parcell of land together with all and singuler its Rights Members and appurtenances thereunto belonging or in any wise appertaining unto the said Cap.t Thomas Wahop his heirs and assignes for ever to the onely proper use and behoofe of James Wahop son to the said Cap.t Thomas Wahop and his heirs and assignes for ever and to noe other use intent nor purpose whatsoever And the said James Jones and Rebecca his wife doe hereby for themselves and their heirs Covenant promise and agree to and with the said Cap.t Thomas Wahop and his heirs that they the said James & Rebecca and their heirs shall and will from time to time and at all times hereafter warrant and defend the p.rmisses unto him the said Cap.t Thomas Wahop and his heirs for the use intent and purpose aforesaid and from all manner of psons claiming by from and under them or any of them In witness whereof the said J James and Rebecca have hereunto put their hands and seales the day and yeare first above written Signed sealed and delivered James Jones in the p.rsence of W.m Cooper Rebecca Jones Charles Carroll W Taylard |
