677) 687 This Indenture made the Thirtieth day of October in the year of our Lord one thousand six hundred Ninety and three Between Alexander Dehiniosa of the Province of Maryland Gent Eldest sone of Allexander Dehiniosa Late of Bomwell in the Province of Gelderland Gent deceased and Anna Catharina the wife of the said Allexander the sonne and Johannes Dehiniosa one other of the sonnes of the said Allexander the sonne on the one part & Peter Sayer of Talbot County in the said Province of Maryland Gent on the other part Witnesseth That for and in Consideration of the sume of one hundred thousand pounds of tobacco to them the said Allexander and Johanes Dehiniosa in hand paid at and before the ensealing hereof by the said Peter Sayer The receipt whereof they the said Allexander and Johannes doe hereby acknowledge accordingly and themselves to be thereof and therewith fully satisfyed and thereof and of every part thereof doe clearly acquitt and discharge the said Peter Sayer his heir Executor and Adm.rs and Adm.rs and every of them for ever by these p.rsents They the said Allexander Dehiniosa the sonne and Anna Catharina his wife and Johannes Dehiniosa have granted bargained sold Aliened enfeoffed and confirmed and by these presents Doe fully clearly and absolutely Graunt bargaine sell alien enfeoff and confirm unto the said Peter Sayer and his heires All that Island tract or parcell of Land lying to the south of the Isle of Kent in the Bay of Chesepeake called Poplars Island Containeing in the whole one thousand Acres or thereabouts now in the possession of the said Peter Sayer And all houses outhouses gardens orchards woods underwoods timber and timber trees ways easements profitts Comodityes and appurtenances to the said Island belonging or appertaining and all the Estate right title interest use possession property claime or demand whatsoever of them the said Allexander and Anna Catherina his wife and Johannes Dehiniosa and any and every of them of in and to the p.rmisses or of in or to any part afor or parcell thereof And all deeds writings Evidences Pattents Chices escripts and muniments whatsoever touching or concerning the p.rmisses or any part thereof And the revercon and revercons remainder and remainders of y.e same To have and to hold the s.d Island and all and singular other the p.rmisses hereby bargained and sold or herein or hereby ment mentioned or intended to be graunted bargained and solde unto the said Peter Sayer his heires and Assignes To the proper use and behoofe of the said Peter Sayer his heires and Assignes absolutely and for ever To be holden of the Cheife Lord or Lords of the Fee or Fees of the premisses by the rents and services therefore due and of right accustomed And the said Allexander Dehiniosa and Johannes Dehiniosa the sonnes the aforesaid Island and premisses with the appurtenances unto the said Peter Sayer and his heirs against them the said Allexander the sonne and Johannes and against their said Father and all clayming under him shall and will warrant and for ever defend by these presents And also the said Allexander Dehiniosa and Johannes Dehiniosa for themselves their heirs executors and Adm.rs doe jointly and severally covenant grant and agree to and with the said Peter Sayer his heires and Assignes by these presents That the said Peter his heires and Assignes & every of them shall & may by force and vertue of these presents from time to time and at all times hereafter Lawfully peaceably and quietly have hold use occupy possess and enjoy the said Island and all other the p.rmisses with the appurtenances hereby graunted bargained and sold and have receive and take the rent issues & profitts thereof to his and their owne proper use and behoofe for ever without any Lawfull lett suite trouble denyall interuption eviccon or disturbance of the said Allexander Denihiosa and Johannes Dehiniosa or any other p.rson or p.rsons lawfully clayming by from or under them or either of them or by from or under the said Allexander Dehiniosa the father deceased and that free and clear and freely and clearly acquitted exonerated and discharged or otherwise sufficiently saved kept harmless and indempnified of and from all and all manner of former guifts and other guifts graunts bargaines sales Leases mortgages dowars titles of dowars wills uses entailes jointures rents and arrerages of rents forfeitures fines Amerciements Judgements extents executions and of and from all and singular other titles troubles debts charges and encumbrances whatsoever had made comitted suffered or done by them the aforesaid bargainers or either of (them |
