666 (656 Act and acts conveyances and assurances for the further and better assureing sure makeing and Conveying the said bargained premisses to the said Edward Day his heires & assignes as by him the said Edward his heires or assignes or his or their Councill learned in the law shall be reasonably devised or advised and required In Wittnes whereof the parties aforesaid to these Indentures interchanably have put their hands and seales the day and yeare first above written Mich Judd (seale) Sealed and delivered by the within named Mich.ll Judd in the p.rsence of October 9.th 1693 James Cullen Came the within named Michaell Judd and in open Court acknowledged this Ind.r to be ^his^ act and deed signed &c W.m Nuthead W Taylard Clk Rec 12.th Oct.r 1693 Tho Grunwin Prov.ll Cor.t This Indenture made The thirteenth day of May In the yeare of our Lord one thousand six hundred Ninety and three Beetween Elias Beech of S.t Maryes County in the province of Maryland planter on the one part and Thomas Loker of the same County planter on the other part Witnesseth that the said Elias Beech for and in Consideracon that the said Thomas Loker hath given up his right in a Tract of land lyeing in Blewstone neck in the said County of S.t Maryes to Elizabeth Baker and the Consideracon paid to the said Elias Beech and for and in Consideracon of the sume of five shillings sterl of lawfull Money of England to him the said Elias Beech by the said Thomas Loker paid The receipt whereof is hereby acknowledged accordingly Hath granted bargained sold aliened enfeoffed and Confirmed and by these presents doth fully clearly and absolutely grant bargaine sell alien enfeoff and Confirme unto the said Thomas Loker All that tract or parcell of land now in the possession of the said Thomas Loker adjoyning to and being part of a larger tract of the said Elias Beech purchased from William Guyther lying in S.t Marys Michaells hundred in S.t Marys County aforesaid begining at a point called Tom longs poynt soe runing up a branch of S.t Hellens Creek to a Marked Chesnutt Oake standing on a little valy in the same Creeke from thence Easterly cross the neck to a marked white Oake standing on the bay side and soe along the bay side to Thomas Long point aforesaid And all houses outhouses tobacco houses orchards gardens woods und.rwoods timber and timber trees wayes Easments proffitts Comodities and appurtenances to the said tract butted and bounded as aforesaid belonging or in any wise apperteyning To have and to hold the said Tract of land and premisses hereby bargained and sold belonging or in any wise appartaineing unto the said Thomas Loker his heires & assignes to the onely proper use and behoofe of the said Thomas Loker his heires and assignes absolutely and for ever to be holden of the Lord of the fee by the rents and services therefore proporconably due and of right accustomed And the said Elias Beech for him and his heires the said Bargained tract of land and premisses against the said Elias & the said William Guither and all Clayming und.r them or either of them unto the said Thomas Loker and his heires shall and will warrant and for ever defend by these presents And the said Elias Beech for him his heires executo.rs & administrato.rs & for every of them doth Covenant grant and agree to and with the said Thomas Loker his heires and assignes by these presents that he the said Thomas Loker his heires and assignes shall and may from hence forth for ever hereafter peaceably and quietly have hold occupy possesse and enjoy the said tract of land hereby bargained and sold with the appurtenances free and cleare and freely and clearly acquitted Exonerated and discharged or otherwise well and sufficiently saved Kept harmeless and indempnified of and from all and all Manner of former and other bargaines sales guifts grants titles troubles debts charges rents and arrerages and incumbrances whatsoever had made comitted or done by the said Elias Beech and William Guither or either of them the quit rent from henceforth to become due for the said bargained premisses alwayes excepted And the said Elias Beech doth further for him and his heires and assignes doth covenant grant and agree to and with the said Thomas Loker his heires and assignes by these presents that the said Elias Beech and all clayming under him shall and will at all times hereafter upon the reasonable Request and at the Cost and charges in the law fo the said Thomas Loker his heires and assignes make and grant unto him or them such further and other lawfull and reasonable act and acts conveyances and assureances for the further and assureing sure making and Conveying the said bargained premisses to the said Thomas Loker & his heires as by him |
