62 date herewith & made between the said Richard Windall of the one part & the said Marke Cordea & John Addison of the other part amongst many other things therein Contained may appeare And whereas the said John Addison hath already the Quantity & Number of one hundred Thousand & foure Thousand & nine hundred pounds weight Neat good sound & Merchantable leafe Tobacco of the proper Goods & Merchandizes of the said Thomas Addison in his owne hand & Custody in Maryland aforesaid It is therefore Covenanted Concluded & agreed upon by & between the said parties to these presents And the said John Addison for himselfe his Ex.rs & Adm.rs doth Covenant & grant to & with the said Thomas Addison his Executo.rs & Administrators Factors or assignes that he the said John Addison his Executors Administrators or Assignes shall well and truly pay & deliver or Cause to be truly paid or delivered unto the said Thomas Addison his Executors Administrators Factors & assignes the said one hundred Thousand & foure Thousand & nine hundred pounds weight Neat good sound merchantable leafe Tobacco & Caske according to the Custome of Maryland aforesaid in manner following that is to say Thirty foure Thousand pounds weight neat good sound Merchantable leafe Tobacco to Containe Eighty hogsheads or thereabouts att or before the Tenth day of March next Ensueing the date hereof or within Twenty dayes next after the first Arrivall of the said shipp at S.t Maryes River as aforesaid or which shall first come & happen there to be loaden aboard the said shippe And seventy Thousand & nine hundred pounds weight neat of like Tobacco & Caske the residue & remainder thereof before the Tenth day of October which will be in the yeare of our Lord God One Thousand six hundred Seaventy Eight And it is agreed by & between the said parties to these presents that the said Thirty foure Thousand pounds weight Neat Sound Merchantable Leafe Tobacco shall be delivered to the said Thomas Addison his Executors Administrators & assignes or Attorney att Convenient place or places in the said River of Maryland where sloops may safely take in the same to be putt on board the said shipp (in Case she arrive there) in bulke & Caske as may be thought Convenient to & for the account & proper use of the said Thomas Addison his Executors Administrators & assignes which said Tobacco shall be accounted according to the first weighing & Booke Entrey of the same anything herein Contained to the Contrary notwithstanding And the said Thomas Addison for himselfe his Executo.rs & Administrators doth Covenant promise & grant to & with the said John Addison his Executors Administrators or assignes that he the said Thomas Addison his Executors & Administrators shall & will pay or allow & discount to the said John Addison his Executors Administrators & assignes all reasonable Costs & Charges that shall be Expended in Shipping the said Thirty foure thousand pounds weight neat sound merchantable leafe Tobacco & shall runn all resque & hazards of the same by water fire & Enemies & shall alsoe pay & Cleare of all such monyes as shall become due to the said Master at his returne his Executors administrators or assignes far streight of the said Thirty foure Thousand pounds weight Neat Marchantable leafe Tobacco & Caskes as aforesaid Rateably & Proporcenably to the full stewage & whole freight of the said shipp & other demands of the said Master his Executors or assignes by virtue of the said Charter party and according to the true meaning thereof over & besides all Customes Duties & other costs & Charges whatsoever as is Expressed in the said Charter party And it is further agreed by & between the said parties thereunto that all such Tobacco as the said John Addison his Ex.rs adm.rs shall load on board the said shipe for the proper use & uses of the said Thomas Addison his Executors administrators & assignes over & above the said Thirty foure Thousand pounds weight Neat Tobacco as aforesaid shall be in part of payment & Defalked out of the remainder Seaventy Thousand & nine hundred pounds weight Neat Tobacco & Caskes as aforesaid the said Thomas Addison his Executors Administrators & assignes praying of all freight moneys & demands proporconably to the ^said^ ships full loading as aforesaid besides all the Customes Duties & Charges before Expressed In wittnes whereof the parties abovesaid have hereto Interchangeably putt their hands & seales the day & yeare first above written Sealed & delivered in the p.rsence of John Addison sealed Richard Windall Christopher Aglionby James Hodgson Tho Warmingham Ita test Sam.ll Fazakerly Not.rius Pub.lus Liverpoole |
