effectually as if myne & her names as appearing has been therein incerted Wittnes my hand & seale the seven & Twentieth of Decemb.r one thousand six hundred seaventy seaven Sealed & delivered in the p.rsence of The marke of Henry H Marrot locus silgilli Guil Scorey Not.rius Pub.lus 1677 Jn.o Pakeman To all People to whom these p.rsents shall come greeting in acc.t I Thomas Addison of Whitehaven in the County of Cumberland within the Kingdome of England Gentl sends Greeting in our Lord God Everlasting Know yee that I the said Thomas Addison for sufficient Courses & Valuable Consideracons me hereunto especially moveing have made ordained Constituted & in my stead & place put & Deputed & by these p.rsents doe make ordaine Constitute & in my stead & place put & Depute Christopher Agliouby of the Citty of Carlile in the said County of Cumberland Tobacconist my true & lawfull Factor & Attorney for me & in my name & to my use to aske demand sue for Recover & receive of an from John Addison of S.t Georges in the County of S.t Maryes in the Province of Maryland Merchant the sume or quantity of one hundred Thousand & foure thousand Nine hundred pounds weight neet of good sound Marcha^n^table Lease Tobacco & Caske according to the Custome of Maryland aforesaid att the dayes hereafter mentioned Viz.t Thirty four thousand pounds weight neet & Caske as aforesaid part of the said Tobacco att or before the Tenth day of March Next Ensueing the date hereof And the further sume or quantity of Seaventy Thousand Nine hundred pounds weight neete of the like good sound Marchantable Leafe Tobacco & Caske according to the Custome as aforesaid Upon or before the tenth day of October which will be in the yeare of Our Lord God One Thousand Six hundred Seaventy eight at Convenient place or places ^upon the river of S.t Maryes aforesaid or in other convenient place or places^ where the said Tobacco & every part thereof may be loaded into Hoaps in order to the shiping thereof for England which said sumes & quantityes of Tobacco are due & belonging unto me the said Thomas Addison my Ex.rs Adm.rs & assignes as by Certaine Artickles & bonds under the hand & seale of the said John Addison bearing date of with these p.rsents doth & may more fully appeare And for default of payment of the aforesaid sumes or quantityes of Tobacco or any part or parcell thereof or not doeing & performing all & Every the Covenants promises & things whatsoever relateing to the performing & paying the aforesaid sumes and quantityes of Tobacco at the dayes & Convenient places aforesaid I the said Thomas Addison doe hereby fully Authorize & impower the said Christopher Agliouby to have use & take all lawfull wayes & meanes whatsoever in my Name or therewise for the Recovery thereof by attachments arrests distresses or otherwise according to Lawes of the Country in Maryland aforesaid & acquittances & other sufficient discharges for the same for me & in my name to make seall & deliver And to doe all other lawfull Acts & things whatsoever Concerning the p.rmisses as fully in Every respect as my selfe might or could doe if I were personally p.rsent & Attorney one or more under him for the purpose aforesaid to make & ordaine & againe at his pleasure to revoake And I the said Thomas Addison doe hereby ratifie & Confirme whatsoever my said Attorney shall ^lawfully^ doe or cause to be done in my name or otherwise by Virtue & force of these presents In Wittnesse whereof I have hearunto sett my hand & seale the Eighteenth day of September in the Nine & Twentieth yeare of the Raigne of our Soveraigne Lord King Charles the second & in the yeare of our Lord God One Thousand six hundred seaventy seaven Sealed Signed & delivered in the presence of us Thomas Addison sealed W.m Bonn Tho Warmingham Sam.ll Fazakerly W.m Bonn evidence to the within Letter of A^ttorney^ by his oath taken before me this seaventh day of May one thousand six hundred seaventy eight proved this same letter of Attorney to be sealed ^& delivered^ to Christopher Agliouby by the Constituant Thomas Addison as his act & deed Philip Calvert Articles of agreement Indented made the Eighteen day of September Anno Domi one Thousand six ^hundred^ Seaventy Seaven Between John Addison of S.t Georges in the County of S.t Maryes in Maryland Merchant of the one part & Thomas Addison of Whitehaven Gentl of the other part as followeth viz.t Whereupon the said John Addison & Marke Cordea have taken to freight the Good shipp Called the Liverpoole Merchant of the Burden of Eighty Tuns or thereabouts (whereof Richard Windall is Master) for a Voyage for Six months Certaine & foure Months more uncertaine att the rate of sixty six pounds sterling p month by Gods assistance) to be made from dubline to S.t Maryes River in Maryland & soe backe to Liverpoole Chester or Peehafeidre to be discharged from the said Voyage as by Charter party of affreightment Indented beareing Even |
